99 AN ACT
1010 relating to the use for administrative costs of a portion of money
1111 received by certain entities to implement a supplemental
1212 environmental project.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 7.067, Water Code, is amended by adding
1515 Subsection (c) to read as follows:
1616 (c) The commission may allow a local government or an
1717 organization exempt from federal income taxation under Section
1818 501(a), Internal Revenue Code of 1986, as an organization described
1919 by Section 501(c)(3) of that code, that receives money from a
2020 respondent to implement a supplemental environmental project under
2121 this section to use a portion of the money, not to exceed 10 percent
2222 of the direct cost of the project, for administrative costs,
2323 including overhead costs, personnel salary and fringe benefits, and
2424 travel and per diem expenses, associated with implementing the
2525 project. Money used for administrative costs under this subsection
2626 must be used in accordance with Chapter 783, Government Code.
2727 SECTION 2. Section 7.067(c), Water Code, as added by this
2828 Act, applies to money received to implement a supplemental
2929 environmental project under Section 7.067, Water Code, regardless
3030 of whether the money was received on, before, or after the effective
3131 date of this Act.
3232 SECTION 3. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2013.
