77 relating to creating the offense of voyeurism; providing a penalty.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 21, Penal Code, is amended by adding
1010 Section 21.16 to read as follows:
1111 Sec. 21.16. VOYEURISM. (a) A person commits an offense if,
1212 with the intent to arouse or gratify the sexual desire of any
1313 person, the actor observes another person without the other
1414 person's consent by looking:
1515 (1) through a window or other opening in a:
1616 (A) dwelling on private property:
1717 (i) while the actor is on the premises of
1818 the private property; or
1919 (ii) with binoculars, a telescope, or
2020 another similar device while the actor is on the premises of a place
2121 the actor is legally authorized to be; or
2222 (B) guest room of a hotel or other facility for
2323 the accommodation of transient guests, other than a room in which
2424 the actor is legally authorized to be, while the actor is on the
2525 premises of the hotel or other facility; or
2626 (2) into an area that is designed to provide privacy to
2727 another person using the area, such as a restroom or shower stall or
2828 changing or dressing room while the actor is on the premises of a
2929 public place.
3030 (b) An offense under this section is a Class B misdemeanor.
3131 SECTION 2. This Act takes effect September 1, 2013.
