| 7 | 7 | | relating to creating the offense of voyeurism; providing a penalty. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Chapter 21, Penal Code, is amended by adding |
|---|
| 10 | 10 | | Section 21.16 to read as follows: |
|---|
| 11 | 11 | | Sec. 21.16. VOYEURISM. (a) A person commits an offense if, |
|---|
| 12 | 12 | | with the intent to arouse or gratify the sexual desire of any |
|---|
| 13 | 13 | | person, the actor observes another person without the other |
|---|
| 14 | 14 | | person's consent by looking: |
|---|
| 15 | 15 | | (1) through a window or other opening in a: |
|---|
| 16 | 16 | | (A) dwelling on private property: |
|---|
| 17 | 17 | | (i) while the actor is on the premises of |
|---|
| 18 | 18 | | the private property; or |
|---|
| 19 | 19 | | (ii) with binoculars, a telescope, or |
|---|
| 20 | 20 | | another similar device while the actor is on the premises of a place |
|---|
| 21 | 21 | | the actor is legally authorized to be; or |
|---|
| 22 | 22 | | (B) guest room of a hotel or other facility for |
|---|
| 23 | 23 | | the accommodation of transient guests, other than a room in which |
|---|
| 24 | 24 | | the actor is legally authorized to be, while the actor is on the |
|---|
| 25 | 25 | | premises of the hotel or other facility; or |
|---|
| 26 | 26 | | (2) into an area that is designed to provide privacy to |
|---|
| 27 | 27 | | another person using the area, such as a restroom or shower stall or |
|---|
| 28 | 28 | | changing or dressing room while the actor is on the premises of a |
|---|
| 29 | 29 | | public place. |
|---|
| 30 | 30 | | (b) An offense under this section is a Class B misdemeanor. |
|---|
| 31 | 31 | | SECTION 2. This Act takes effect September 1, 2013. |
