| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 11.46, Alcoholic Beverage Code, is |
|---|
| 11 | 11 | | amended by adding Subsection (d) to read as follows: |
|---|
| 12 | 12 | | (d) The commission or administrator shall refuse to issue an |
|---|
| 13 | 13 | | original permit authorizing the retail sale of alcoholic beverages |
|---|
| 14 | 14 | | before the first anniversary of the date an original or renewal |
|---|
| 15 | 15 | | license or permit application filed by the same applicant for the |
|---|
| 16 | 16 | | same premises is refused, unless the condition that caused the |
|---|
| 17 | 17 | | refusal is addressed or resolved. |

| 18 | 18 | | SECTION 2. Section 61.42, Alcoholic Beverage Code, is |
|---|
| 19 | 19 | | amended by adding Subsection (d) to read as follows: |
|---|
| 20 | 20 | | (d) The county judge, commission, or administrator shall |
|---|
| 21 | 21 | | refuse to approve or issue an original license authorizing the |
|---|
| 22 | 22 | | retail sale of alcoholic beverages before the first anniversary of |
|---|
| 23 | 23 | | the date an original or renewal license or permit application filed |
|---|
| 24 | 24 | | by the same applicant for the same premises is refused, unless the |
|---|
| 25 | 25 | | condition that caused the refusal is addressed or resolved. |

| 26 | 26 | | SECTION 3. The changes in law made by this Act apply only |
|---|
| 27 | 27 | | with respect to an original or renewal alcoholic beverage permit or |
|---|
| 28 | 28 | | license application refused on or after the effective date of this |
|---|
| 29 | 29 | | Act. |
|---|
| 30 | 30 | | SECTION 4. This Act takes effect September 1, 2013. |
