A BILL TO BE ENTITLED
AN ACT
relating to applications for certain alcoholic beverage permits and
licenses.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 11.46, Alcoholic Beverage Code, is
amended by adding Subsection (d) to read as follows:
(d) The commission or administrator shall refuse to issue an
original permit authorizing the retail sale of alcoholic beverages
before the first anniversary of the date an original or renewal
license or permit application filed by the same applicant for the
same premises is refused, unless the condition that caused the
refusal is addressed or resolved.
SECTION 2. Section 61.42, Alcoholic Beverage Code, is
amended by adding Subsection (d) to read as follows:
(d) The county judge, commission, or administrator shall
refuse to approve or issue an original license authorizing the
retail sale of alcoholic beverages before the first anniversary of
the date an original or renewal license or permit application filed
by the same applicant for the same premises is refused, unless the
condition that caused the refusal is addressed or resolved.
SECTION 3. The changes in law made by this Act apply only
with respect to an original or renewal alcoholic beverage permit or
license application refused on or after the effective date of this
Act.
SECTION 4. This Act takes effect September 1, 2013.
