88 AN ACT
99 relating to the authority of a county to assess costs and fees
1010 relating to the abatement of a nuisance on real property against
1111 certain persons.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Sections 343.022(b) and (c), Health and Safety
1414 Code, are amended to read as follows:
1515 (b) The abatement procedures must require that written
1616 notice be given to:
1717 (1) the owner [, lessee, occupant, agent, or person in
1818 charge] of the premises or an agent of the owner; and
1919 (2) the person responsible for causing a public
2020 nuisance on the premises when:
2121 (A) that person is not the owner[, lessee,
2222 occupant, agent, or person in charge] of the premises or an agent of
2323 the owner; and
2424 (B) the person responsible can be identified.
2525 (c) The notice must state:
2626 (1) the specific condition that constitutes a
2727 nuisance;
2828 (2) that the person receiving notice shall abate the
2929 nuisance before the:
3030 (A) 31st day after the date on which the notice is
3131 served, if the person has not previously received a notice
3232 regarding a nuisance on the premises; or
3333 (B) 10th business day after the date on which the
3434 notice is served, if the person has previously received a notice
3535 regarding a nuisance on the premises;
3636 (3) that failure to abate the nuisance may result in:
3737 (A) abatement by the county;
3838 (B) assessment of costs against [to] the person
3939 receiving the notice [responsible for causing the nuisance when
4040 that person can be identified]; and
4141 (C) a lien against the property on which the
4242 nuisance exists[, if the person responsible for causing the
4343 nuisance has an interest in the property];
4444 (4) that if the county seeks to recover abatement
4545 costs, including legal notification and administrative fees, the
4646 county will make an effort to recover costs from the person
4747 responsible for causing the nuisance, if that person can be
4848 identified, before assessing costs against the owner of the
4949 premises;
5050 (5) that the county may prohibit or control access to
5151 the premises to prevent a continued or future nuisance described by
5252 Section 343.011(c)(1), (6), (9), or (10); and
5353 (6) [(5)] that the person receiving notice is entitled
5454 to submit a written request for a hearing before the:
5555 (A) 31st day after the date on which the notice is
5656 served, if the person has not previously received a notice
5757 regarding a nuisance on the premises; or
5858 (B) 10th business day after the date on which the
5959 notice is served, if the person has previously received a notice
6060 regarding a nuisance on the premises.
6161 SECTION 2. Section 343.023, Health and Safety Code, is
6262 amended by amending Subsection (a) and adding Subsections (g) and
6363 (h) to read as follows:
6464 (a) Except as provided by Subsection (g), a [A] county may:
6565 (1) assess against a person receiving notice under
6666 Section 343.022:
6767 (A) the cost of abating the nuisance, including
6868 management, remediation, storage, transportation, and disposal
6969 costs, and damages and other expenses incurred by the county;
7070 (B) the cost of legal notification by
7171 publication; and
7272 (C) an administrative fee of not more than $100
7373 [on the person receiving notice under Section 343.022]; or
7474 (2) by resolution or order, assess against the
7575 property on which the nuisance exists:
7676 (A) the cost of abating the nuisance;
7777 (B) the cost of legal notification by
7878 publication; and
7979 (C) an administrative fee of not more than $100
8080 [against the property on which the nuisance exists].
8181 (g) Before assessing costs and fees against an owner of the
8282 premises under this section, a county must attempt to recover the
8383 costs from the person responsible for causing the nuisance if that
8484 person can be identified.
8585 (h) The county may file a civil action in district court to
8686 recover the costs and fees assessed against a person under this
8787 section and interest on the unpaid costs and fees. The court may
8888 award court costs and reasonable attorney's fees to the prevailing
8989 party.
9090 SECTION 3. (a) Sections 343.022(b) and (c), Health and
9191 Safety Code, as amended by this Act, apply only to a notice given on
9292 or after the effective date of this Act. A notice given before the
9393 effective date of this Act is governed by the law as it existed
9494 immediately before the effective date of this Act, and the former
9595 law is continued in effect for that purpose.
9696 (b) Section 343.023, Health and Safety Code, as amended by
9797 this Act, applies only to an assessment of costs for which notice
9898 was given on or after the effective date of this Act. An assessment
9999 of costs for which notice was given before the effective date of
100100 this Act is governed by the law as it existed immediately before the
101101 effective date of this Act, and the former law is continued in
102102 effect for that purpose.
103103 SECTION 4. This Act takes effect September 1, 2013.
