11 | 11 | | relating to reimbursement of health care services rendered by a |

12 | 12 | | health care provider for an inmate of a county jail or another |
---|
13 | 13 | | county correctional facility. |

14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

15 | 15 | | SECTION 1. Section 61.036(c), Health and Safety Code, is |
---|
16 | 16 | | amended to read as follows: |
---|
17 | 17 | | (c) Regardless of the application, documentation, and |
---|
18 | 18 | | verification procedures or eligibility standards established by |
---|
19 | 19 | | the department under Subchapter A, a county may credit an |
---|
20 | 20 | | expenditure for an eligible resident toward eligibility for state |
---|
21 | 21 | | assistance if the eligible resident received the health care |
---|
22 | 22 | | services at: |
---|
23 | 23 | | (1) a hospital maintained or operated by a state |
---|
24 | 24 | | agency that has a contract with the county to provide health care |
---|
25 | 25 | | services; [or] |
---|
26 | 26 | | (2) a federally qualified health center delivering |
---|
27 | 27 | | federally qualified health center services, as those terms are |
---|
28 | 28 | | defined in 42 U.S.C. Sections 1396d(l)(2)(A) and (B), that has a |
---|
29 | 29 | | contract with the county to provide health care services; or |
---|
30 | 30 | | (3) a hospital or other health care provider if the |
---|
31 | 31 | | eligible resident is an inmate of a county jail or another county |
---|
32 | 32 | | correctional facility. |
---|
33 | 33 | | SECTION 2. This Act takes effect September 1, 2013. |
