88 A BILL TO BE ENTITLED
99 AN ACT
1010 relating to a study to determine the reasons major manufacturers
1111 have chosen to invest in other states after considering development
1212 in this state.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. In this Act, "major manufacturer" means a person
1515 that:
1616 (1) is engaged in the business of manufacturing;
1717 (2) invested $1 million or more in developing,
1818 expanding, or maintaining manufacturing operations in another
1919 state after September 1, 2011, and before September 1, 2014; and
2020 (3) was offered economic incentives by the state or a
2121 local government related to developing, expanding, or maintaining
2222 manufacturing operations in this state before choosing to make that
2323 investment.
2424 SECTION 2. The comptroller of public accounts shall conduct
2525 a study on the reasons major manufacturers have chosen to invest in
2626 other states after the manufacturers were offered economic
2727 incentives by the state or a local government to develop in this
2828 state. The study may include examining those reasons specific to
2929 the economic incentives that were offered and to the promotion of
3030 manufacturing development. The comptroller's office shall solicit
3131 interviews with an executive of each major manufacturer that
3232 declined the incentives. The interviews must address
3333 recommendations for this state to effectively compete with other
3434 states in promoting manufacturing development.
3535 SECTION 3. Not later than December 1, 2014, the comptroller
3636 of public accounts shall provide a report on the results of the
3737 study, including an analysis of the results, to the speaker of the
3838 house of representatives, the lieutenant governor, the governor,
3939 and each standing committee of the legislature that has relevant
4040 jurisdiction.
4141 SECTION 4. This Act expires January 1, 2015.
4242 SECTION 5. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2013.
