1010 of higher education.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 61.0593(e), Education Code, is amended
1313 to read as follows:
1414 (e) Notwithstanding Subsection (d),[:
1515 [(1) not more than 10 percent of the total amount of
1616 general revenue appropriations of base funds for undergraduate
1717 education recommended by the board for all institutions to which
1818 Subsection (d) applies for a state fiscal biennium may be based on
1919 student success measures; and
2020 [(2)] the board's recommendation for base funding for
2121 undergraduate education based on student success measures does not
2222 reduce or otherwise affect funding recommendations for graduate
2323 education.
2424 SECTION 2. Chapter 322, Government Code, is amended by
2525 adding Section 322.0082 to read as follows:
2626 Sec. 322.0082. STUDENT SUCCESS-BASED FUNDING FOR CERTAIN
2727 INSTITUTIONS OF HIGHER EDUCATION. (a) In this section, "general
2828 academic teaching institution" and "public state college" have the
2929 meanings assigned by Section 61.003, Education Code.
3030 (b) In the general appropriations bill prepared for
3131 introduction to the legislature under Section 322.008, at least 25
3232 percent of the total amount of general revenue appropriations of
3333 base funds for undergraduate education for all general academic
3434 teaching institutions, other than public state colleges, for a
3535 state fiscal biennium must be based on student success measures
3636 described by Section 61.0593(d), Education Code.
3737 (b-1) Subsection (b) does not apply to a state fiscal
3838 biennium before the state fiscal biennium ending August 31, 2019.
3939 In the general appropriations bill prepared for introduction to the
4040 legislature under Section 322.008 for the state fiscal biennium
4141 ending August 31, 2017, at least 15 percent of the total amount of
4242 general revenue appropriations of base funds for undergraduate
4343 education for all general academic teaching institutions, other
4444 than public state colleges, for that state fiscal biennium must be
4545 based on student success measures described by Section 61.0593(d),
4646 Education Code. This subsection expires September 1, 2017.
4747 (c) In preparing the general appropriations bill to comply
4848 with the requirements of this section, the director, under the
4949 direction of the board, shall consider the Texas Higher Education
5050 Coordinating Board's recommendations under Section 61.0593(d),
5151 Education Code.
5252 SECTION 3. This Act takes effect September 1, 2013.
