| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 61.0593(e), Education Code, is amended |
|---|
| 13 | 13 | | to read as follows: |
|---|
| 14 | 14 | | (e) Notwithstanding Subsection (d),[: |
|---|
| 15 | 15 | | [(1) not more than 10 percent of the total amount of |
|---|
| 16 | 16 | | general revenue appropriations of base funds for undergraduate |
|---|
| 17 | 17 | | education recommended by the board for all institutions to which |
|---|
| 18 | 18 | | Subsection (d) applies for a state fiscal biennium may be based on |
|---|
| 19 | 19 | | student success measures; and |
|---|
| 20 | 20 | | [(2)] the board's recommendation for base funding for |
|---|
| 21 | 21 | | undergraduate education based on student success measures does not |
|---|
| 22 | 22 | | reduce or otherwise affect funding recommendations for graduate |
|---|
| 23 | 23 | | education. |
|---|
| 24 | 24 | | SECTION 2. Chapter 322, Government Code, is amended by |
|---|
| 25 | 25 | | adding Section 322.0082 to read as follows: |
|---|
| 26 | 26 | | Sec. 322.0082. STUDENT SUCCESS-BASED FUNDING FOR CERTAIN |
|---|
| 27 | 27 | | INSTITUTIONS OF HIGHER EDUCATION. (a) In this section, "general |
|---|
| 28 | 28 | | academic teaching institution" and "public state college" have the |
|---|
| 29 | 29 | | meanings assigned by Section 61.003, Education Code. |
|---|
| 30 | 30 | | (b) In the general appropriations bill prepared for |
|---|
| 31 | 31 | | introduction to the legislature under Section 322.008, at least 25 |
|---|
| 32 | 32 | | percent of the total amount of general revenue appropriations of |
|---|
| 33 | 33 | | base funds for undergraduate education for all general academic |
|---|
| 34 | 34 | | teaching institutions, other than public state colleges, for a |
|---|
| 35 | 35 | | state fiscal biennium must be based on student success measures |
|---|
| 36 | 36 | | described by Section 61.0593(d), Education Code. |
|---|
| 37 | 37 | | (b-1) Subsection (b) does not apply to a state fiscal |
|---|
| 38 | 38 | | biennium before the state fiscal biennium ending August 31, 2019. |

| 39 | 39 | | In the general appropriations bill prepared for introduction to the |
|---|
| 40 | 40 | | legislature under Section 322.008 for the state fiscal biennium |
|---|
| 41 | 41 | | ending August 31, 2017, at least 15 percent of the total amount of |
|---|
| 42 | 42 | | general revenue appropriations of base funds for undergraduate |
|---|
| 43 | 43 | | education for all general academic teaching institutions, other |
|---|
| 44 | 44 | | than public state colleges, for that state fiscal biennium must be |
|---|
| 45 | 45 | | based on student success measures described by Section 61.0593(d), |
|---|
| 46 | 46 | | Education Code. This subsection expires September 1, 2017. |
|---|
| 47 | 47 | | (c) In preparing the general appropriations bill to comply |
|---|
| 48 | 48 | | with the requirements of this section, the director, under the |
|---|
| 49 | 49 | | direction of the board, shall consider the Texas Higher Education |
|---|
| 50 | 50 | | Coordinating Board's recommendations under Section 61.0593(d), |
|---|
| 51 | 51 | | Education Code. |
|---|
| 52 | 52 | | SECTION 3. This Act takes effect September 1, 2013. |
