 A BILL TO BE ENTITLED
 AN ACT
 relating to the appointment of a state cybersecurity coordinator.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Chapter 2054, Government Code, is amended by
 adding Subchapter O to read as follows:
 SUBCHAPTER O. STATE CYBERSECURITY
 Sec. 2054.551.  CYBERSECURITY COORDINATOR. The executive
 director shall designate an employee of the department as the state
 cybersecurity coordinator to oversee cybersecurity matters for
 this state.
 Sec. 2054.552.  PRIVATE INDUSTRY-GOVERNMENT COUNCIL. The
 state cybersecurity coordinator may establish a council that
 includes public and private sector leaders and cybersecurity
 practitioners to collaborate on matters of cybersecurity
 concerning this state.
 Sec. 2054.553.  CYBERSECURITY APPROVAL SEAL.  The state
 cybersecurity coordinator may establish a voluntary program that
 recognizes private and public entities functioning with exemplary
 cybersecurity practices.
 Sec. 2054.554.  RECOMMENDATIONS.  The state cybersecurity
 coordinator may implement any portion or all of the recommendations
 made by the Cybersecurity, Education, and Economic Development
 Council under Subchapter N.
 SECTION 2.  Not later than December 31, 2013, the executive
 director of the Department of Information Resources shall designate
 a state cybersecurity coordinator, as required by Section 2054.551,
 Government Code, as added by this Act.
 SECTION 3.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect on the 91st day after the last day of the
 legislative session.
