99 relating to the applicability of the law governing emergency
1010 authorizations by the Texas Commission on Environmental Quality for
1111 the use of state water to certain emergency orders concerning water
1212 rights issued by the executive director of the commission.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. The heading to Section 11.053, Water Code, is
1515 amended to read as follows:
1616 Sec. 11.053. COMMISSION AUTHORITY TO SUSPEND OR ADJUST
1717 [EMERGENCY ORDER CONCERNING] WATER RIGHTS DURING PERIODS OF DROUGHT
1818 OR WATER SHORTAGE.
1919 SECTION 2. Section 11.053(a), Water Code, is amended to
2020 read as follows:
2121 (a) During a period of drought or other emergency shortage
2222 of water, as defined by commission rule, the executive director by
2323 order may, in accordance with the priority of water rights
2424 established by Section 11.027:
2525 (1) temporarily suspend the right of any person who
2626 holds a water right to use the water; and
2727 (2) temporarily adjust the diversions of water by
2828 water rights holders to address an imminent hazard to the health,
2929 safety, or welfare of the public.
3030 SECTION 3. The heading to Section 11.139, Water Code, is
3131 amended to read as follows:
3232 Sec. 11.139. REQUEST TO TRANSFER WATER TEMPORARILY
3333 [EMERGENCY AUTHORIZATIONS].
3434 SECTION 4. Section 11.139, Water Code, is amended by
3535 amending Subsections (b), (h), and (j) and adding Subsection (m) to
3636 read as follows:
3737 (b) A person desiring to obtain an emergency authorization
3838 to transfer water temporarily under Subsection (h) [this section]
3939 shall submit to the commission a sworn application containing the
4040 following information:
4141 (1) a description of the condition of emergency
4242 justifying the granting of the emergency authorization;
4343 (2) a statement setting forth facts which support the
4444 findings required under this section;
4545 (3) an estimate of the dates on which the proposed
4646 authorization should begin and end;
4747 (4) a description of the action sought and the
4848 activity proposed to be allowed, mandated, or prohibited; and
4949 (5) any other statements or information required by
5050 the commission.
5151 (h) The commission may grant an emergency authorization
5252 under this section for the temporary transfer and use of all or part
5353 of a permit, certified filing, or certificate of adjudication for
5454 other than domestic or municipal use to a retail or wholesale water
5555 supplier for public health and safety purposes. In addition to the
5656 requirements contained in Subsection (b) [of this section], the
5757 commission may direct that the applicant will timely pay the
5858 amounts for which the applicant may be potentially liable under
5959 Subsection (j) [of this section] and to the extent authorized by law
6060 will fully indemnify and hold harmless the state, the executive
6161 director, and the commission from any and all liability for the
6262 authorization sought. The commission may order bond or other
6363 surety in a form acceptable to the commission as a condition for
6464 such emergency authorization. The commission may not grant an
6565 emergency authorization under this section which would cause a
6666 violation of a federal regulation. The commission may not grant an
6767 emergency authorization under this subsection until a method for
6868 calculating and remitting the compensation due under Subsection (j)
6969 has been agreed on by the person to be granted an emergency
7070 authorization for the temporary transfer and the holder of the
7171 water right or the water right holder's agent or lessee from whom
7272 the use is to be transferred.
7373 (j) The person granted an emergency authorization for a
7474 temporary transfer under Subsection (h) [of this section] is liable
7575 to the holder of the water right [owner] and the water right
7676 holder's [owner's] agent or lessee from whom the use is transferred
7777 for the fair market value of the water transferred as well as for
7878 any damages caused by the transfer of use. If, within 60 days of the
7979 termination of the authorization, the parties do not agree on the
8080 amount due, or if full payment is not made, either party may file a
8181 complaint with the commission to determine the amount due. The
8282 commission may use dispute resolution procedures for a complaint
8383 filed under this subsection. After exhausting all administrative
8484 remedies under this subsection, an owner from whom the use is
8585 transferred may file suit to recover or determine the amount due in
8686 a district court in the county where the owner resides or has its
8787 headquarters. The prevailing party in a suit filed under this
8888 subsection is entitled to recover court costs and reasonable
8989 attorney's fees.
9090 (m) This section does not apply to a suspension or
9191 adjustment ordered by the executive director under Section 11.053.
9292 SECTION 5. This Act takes effect September 1, 2013.
