99 AN ACT
1010 relating to reporting requirements related to school districts that
1111 obtain exceptions from class size limits.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 25.112, Education Code, is amended by
1414 adding Subsection (h) to read as follows:
1515 (h) A school district granted an exception under Subsection
1616 (d) for a school campus must report to the agency the number of
1717 students in the largest class for each affected grade level at that
1818 campus.
1919 SECTION 2. Section 39.333, Education Code, is amended to
2020 read as follows:
2121 Sec. 39.333. REGIONAL AND DISTRICT LEVEL REPORT. The
2222 agency shall prepare and deliver to the governor, the lieutenant
2323 governor, the speaker of the house of representatives, each member
2424 of the legislature, the Legislative Budget Board, and the clerks of
2525 the standing committees of the senate and house of representatives
2626 with primary jurisdiction over the public school system a regional
2727 and district level report covering the preceding two school years
2828 and containing:
2929 (1) a summary of school district compliance with the
3030 student/teacher ratios and class-size limitations prescribed by
3131 Sections 25.111 and 25.112, including:
3232 (A) the number of campuses and classes at each
3333 campus granted an exception from Section 25.112; [and]
3434 (B) for each campus granted an exception from
3535 Section 25.112, a statement of whether the campus has been awarded a
3636 distinction designation under Subchapter G or has been identified
3737 as an unacceptable campus under Subchapter E; and
3838 (C) for each campus granted an exception from
3939 Section 25.112, the number of students in the largest class for each
4040 affected grade level;
4141 (2) a summary of the exemptions and waivers granted to
4242 campuses and school districts under Section 7.056 or 39.232 and a
4343 review of the effectiveness of each campus or district following
4444 deregulation;
4545 (3) an evaluation of the performance of the system of
4646 regional education service centers based on the indicators adopted
4747 under Section 8.101 and client satisfaction with services provided
4848 under Subchapter B, Chapter 8;
4949 (4) an evaluation of accelerated instruction programs
5050 offered under Section 28.006, including an assessment of the
5151 quality of such programs and the performance of students enrolled
5252 in such programs; and
5353 (5) the number of classes at each campus that are
5454 currently being taught by individuals who are not certified in the
5555 content areas of their respective classes.
5656 SECTION 3. This Act applies beginning with the 2013-2014
5757 school year.
5858 SECTION 4. This Act takes effect immediately if it receives
5959 a vote of two-thirds of all the members elected to each house, as
6060 provided by Section 39, Article III, Texas Constitution. If this
6161 Act does not receive the vote necessary for immediate effect, this
6262 Act takes effect September 1, 2013.
