9	9	AN ACT
10	10	relating to reporting requirements related to school districts that
11	11	obtain exceptions from class size limits.
12	12	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	13	SECTION 1. Section 25.112, Education Code, is amended by
14	14	adding Subsection (h) to read as follows:
15	15	(h) A school district granted an exception under Subsection
16	16	(d) for a school campus must report to the agency the number of
17	17	students in the largest class for each affected grade level at that
18	18	campus.
19	19	SECTION 2. Section 39.333, Education Code, is amended to
20	20	read as follows:
21	21	Sec. 39.333. REGIONAL AND DISTRICT LEVEL REPORT. The
22	22	agency shall prepare and deliver to the governor, the lieutenant
23	23	governor, the speaker of the house of representatives, each member
24	24	of the legislature, the Legislative Budget Board, and the clerks of
25	25	the standing committees of the senate and house of representatives
26	26	with primary jurisdiction over the public school system a regional
27	27	and district level report covering the preceding two school years
28	28	and containing:
29	29	(1) a summary of school district compliance with the
30	30	student/teacher ratios and class-size limitations prescribed by
31	31	Sections 25.111 and 25.112, including:
32	32	(A) the number of campuses and classes at each
33	33	campus granted an exception from Section 25.112; [and]
34	34	(B) for each campus granted an exception from
35	35	Section 25.112, a statement of whether the campus has been awarded a
36	36	distinction designation under Subchapter G or has been identified
37	37	as an unacceptable campus under Subchapter E; and
38	38	(C) for each campus granted an exception from
39	39	Section 25.112, the number of students in the largest class for each
40	40	affected grade level;
41	41	(2) a summary of the exemptions and waivers granted to
42	42	campuses and school districts under Section 7.056 or 39.232 and a
43	43	review of the effectiveness of each campus or district following
44	44	deregulation;
45	45	(3) an evaluation of the performance of the system of
46	46	regional education service centers based on the indicators adopted
47	47	under Section 8.101 and client satisfaction with services provided
48	48	under Subchapter B, Chapter 8;
49	49	(4) an evaluation of accelerated instruction programs
50	50	offered under Section 28.006, including an assessment of the
51	51	quality of such programs and the performance of students enrolled
52	52	in such programs; and
53	53	(5) the number of classes at each campus that are
54	54	currently being taught by individuals who are not certified in the
55	55	content areas of their respective classes.
56	56	SECTION 3. This Act applies beginning with the 2013-2014
57	57	school year.
58	58	SECTION 4. This Act takes effect immediately if it receives
59	59	a vote of two-thirds of all the members elected to each house, as
60	60	provided by Section 39, Article III, Texas Constitution. If this
61	61	Act does not receive the vote necessary for immediate effect, this
62	62	Act takes effect September 1, 2013.
