| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 552.024, Government Code, is amended by |
|---|
| 14 | 14 | | amending Subsection (a) and adding Subsection (a-1) to read as |
|---|
| 15 | 15 | | follows: |
|---|
| 16 | 16 | | (a) Except as provided by Subsection (a-1), each [Each] |
|---|
| 17 | 17 | | employee or official of a governmental body and each former |
|---|
| 18 | 18 | | employee or official of a governmental body shall choose whether to |
|---|
| 19 | 19 | | allow public access to the information in the custody of the |
|---|
| 20 | 20 | | governmental body that relates to the person's home address, home |
|---|
| 21 | 21 | | telephone number, emergency contact information, or social |
|---|
| 22 | 22 | | security number, or that reveals whether the person has family |
|---|
| 23 | 23 | | members. |
|---|
| 24 | 24 | | (a-1) A school district may not require an employee or |
|---|
| 25 | 25 | | former employee of the district to choose whether to allow public |
|---|
| 26 | 26 | | access to the employee's or former employee's social security |
|---|
| 27 | 27 | | number. |

| 28 | 28 | | SECTION 2. Section 552.147, Government Code, is amended by |
|---|
| 29 | 29 | | amending Subsection (a) and adding Subsection (a-1) to read as |
|---|
| 30 | 30 | | follows: |
|---|
| 31 | 31 | | (a) Except as provided by Subsection (a-1), the [The] social |

| 32 | 32 | | security number of a living person is excepted from the |
|---|
| 33 | 33 | | requirements of Section 552.021, but is not confidential under this |
|---|
| 34 | 34 | | section and this section does not make the social security number of |
|---|
| 35 | 35 | | a living person confidential under another provision of this |

| 36 | 36 | | chapter or other law. |

| 37 | 37 | | (a-1) The social security number of an employee of a school |
|---|
| 38 | 38 | | district in the custody of the district is confidential. |

| 39 | 39 | | SECTION 3. Subchapter D, Chapter 11, Education Code, is |
|---|
| 40 | 40 | | amended by adding Section 11.1514 to read as follows: |

| 41 | 41 | | Sec. 11.1514. SOCIAL SECURITY NUMBERS. The board of |
|---|
| 42 | 42 | | trustees of an independent school district shall adopt a policy |
|---|
| 43 | 43 | | prohibiting the use of the social security number of an employee of |
|---|
| 44 | 44 | | the district as an employee identifier other than for tax purposes. |
|---|
| 45 | 45 | | SECTION 4. This Act takes effect September 1, 2013. |
