10	10	A BILL TO BE ENTITLED
11	11	AN ACT
12	12	relating to the use of a credit or charge card by certain state
13	13	agencies to make certain purchases.
14	14	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
15	15	SECTION 1. Section 403.023, Government Code, is amended by
16	16	adding Subsections (b-1) and (b-2) to read as follows:
17	17	(b-1) Except as provided by Subsection (b-2), if the
18	18	comptroller adopts rules authorized under Subsection (b), the rules
19	19	must:
20	20	(1) require a state agency in the executive branch of
21	21	state government to use a credit or charge card to pay for all
22	22	purchases unless the comptroller determines that another method of
23	23	payment is more advantageous to the state; and
24	24	(2) prohibit an employee of a state agency in the
25	25	executive branch of state government from using a personal credit
26	26	or charge card to pay for the state agency's purchases.
27	27	(b-2) Subsection (b-1) does not apply to:
28	28	(1) an institution of higher education as defined by
29	29	Section 61.003, Education Code; or
30	30	(2) the office of the governor.
31	31	SECTION 2. Section 660.021, Government Code, is amended to
32	32	read as follows:
33	33	Sec. 660.021. RULES. (a) The comptroller shall adopt rules
34	34	for the effective and efficient administration of this chapter and
35	35	the travel provisions of the General Appropriations Act.
36	36	(b) Except as provided by Subsection (c), the rules adopted
37	37	by the comptroller under this section must require that if a state
38	38	agency in the executive branch of state government participates in
39	39	a program administered by the comptroller that allows the agency to
40	40	use a credit or charge card to pay for travel expenses:
41	41	(1) the agency shall use the credit or charge card to
42	42	pay for travel expenses required for agency travel, unless the
43	43	comptroller determines that another method of payment is more
44	44	advantageous to the state; and
45	45	(2) an employee of the agency may not use the
46	46	employee's personal credit or charge card to pay for travel
47	47	expenses required for agency travel.
48	48	(c) Subsection (b) does not apply to:
49	49	(1) an institution of higher education as defined by
50	50	Section 61.003, Education Code; or
51	51	(2) the office of the governor.
52	52	SECTION 3. Subchapter B, Chapter 2171, Government Code, is
53	53	amended by adding Section 2171.0521 to read as follows:
54	54	Sec. 2171.0521. PAYMENT FOR TRAVEL SERVICES WITH CREDIT OR
55	55	CHARGE CARD. (a) Except as provided by Subsection (b), if a state
56	56	agency in the executive branch of state government participates in
57	57	a program administered by the comptroller that allows the agency to
58	58	use a credit or charge card to purchase travel services:
59	59	(1) the agency shall use the credit or charge card to
60	60	purchase travel services required for agency travel, unless the
61	61	comptroller determines that another method of purchase is more
62	62	advantageous to the state; and
63	63	(2) an employee of the agency may not use the
64	64	employee's personal credit or charge card to purchase travel
65	65	services required for agency travel.
66	66	(b) This section does not apply to:
67	67	(1) an institution of higher education as defined by
68	68	Section 61.003, Education Code; or
69	69	(2) the office of the governor.
70	70	SECTION 4. This Act takes effect immediately if it receives
71	71	a vote of two-thirds of all the members elected to each house, as
72	72	provided by Section 39, Article III, Texas Constitution. If this
73	73	Act does not receive the vote necessary for immediate effect, this
74	74	Act takes effect September 1, 2013.
