1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to the use of a credit or charge card by certain state
1313 agencies to make certain purchases.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Section 403.023, Government Code, is amended by
1616 adding Subsections (b-1) and (b-2) to read as follows:
1717 (b-1) Except as provided by Subsection (b-2), if the
1818 comptroller adopts rules authorized under Subsection (b), the rules
1919 must:
2020 (1) require a state agency in the executive branch of
2121 state government to use a credit or charge card to pay for all
2222 purchases unless the comptroller determines that another method of
2323 payment is more advantageous to the state; and
2424 (2) prohibit an employee of a state agency in the
2525 executive branch of state government from using a personal credit
2626 or charge card to pay for the state agency's purchases.
2727 (b-2) Subsection (b-1) does not apply to:
2828 (1) an institution of higher education as defined by
2929 Section 61.003, Education Code; or
3030 (2) the office of the governor.
3131 SECTION 2. Section 660.021, Government Code, is amended to
3232 read as follows:
3333 Sec. 660.021. RULES. (a) The comptroller shall adopt rules
3434 for the effective and efficient administration of this chapter and
3535 the travel provisions of the General Appropriations Act.
3636 (b) Except as provided by Subsection (c), the rules adopted
3737 by the comptroller under this section must require that if a state
3838 agency in the executive branch of state government participates in
3939 a program administered by the comptroller that allows the agency to
4040 use a credit or charge card to pay for travel expenses:
4141 (1) the agency shall use the credit or charge card to
4242 pay for travel expenses required for agency travel, unless the
4343 comptroller determines that another method of payment is more
4444 advantageous to the state; and
4545 (2) an employee of the agency may not use the
4646 employee's personal credit or charge card to pay for travel
4747 expenses required for agency travel.
4848 (c) Subsection (b) does not apply to:
4949 (1) an institution of higher education as defined by
5050 Section 61.003, Education Code; or
5151 (2) the office of the governor.
5252 SECTION 3. Subchapter B, Chapter 2171, Government Code, is
5353 amended by adding Section 2171.0521 to read as follows:
5454 Sec. 2171.0521. PAYMENT FOR TRAVEL SERVICES WITH CREDIT OR
5555 CHARGE CARD. (a) Except as provided by Subsection (b), if a state
5656 agency in the executive branch of state government participates in
5757 a program administered by the comptroller that allows the agency to
5858 use a credit or charge card to purchase travel services:
5959 (1) the agency shall use the credit or charge card to
6060 purchase travel services required for agency travel, unless the
6161 comptroller determines that another method of purchase is more
6262 advantageous to the state; and
6363 (2) an employee of the agency may not use the
6464 employee's personal credit or charge card to purchase travel
6565 services required for agency travel.
6666 (b) This section does not apply to:
6767 (1) an institution of higher education as defined by
6868 Section 61.003, Education Code; or
6969 (2) the office of the governor.
7070 SECTION 4. This Act takes effect immediately if it receives
7171 a vote of two-thirds of all the members elected to each house, as
7272 provided by Section 39, Article III, Texas Constitution. If this
7373 Act does not receive the vote necessary for immediate effect, this
7474 Act takes effect September 1, 2013.
