99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the qualification of an area inside a base defense
1212 authority as an enterprise zone.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 2303.101, Government Code, is amended to
1515 read as follows:
1616 Sec. 2303.101. QUALIFICATION FOR ENTERPRISE ZONE
1717 DESIGNATION. An area automatically qualifies for designation as an
1818 enterprise zone if the area is:
1919 (1) a block group, as defined by the most recent
2020 federal decennial census available at the time of designation, in
2121 which at least 20 percent of the residents of the block group have
2222 an income at or below 100 percent of the federal poverty level;
2323 (2) an area designated by the federal government as a
2424 renewal community, a federal empowerment zone, or a federal
2525 enterprise community, including any developable area approved by
2626 the federal agency responsible for making that designation; [or]
2727 (3) an area located in a distressed county; or
2828 (4) an area inside the boundaries of a defense base
2929 development authority established under Chapter 379B, Local
3030 Government Code.
3131 SECTION 2. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2013.
