| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Section 2303.101, Government Code, is amended to |
|---|
| 15 | 15 | | read as follows: |
|---|
| 16 | 16 | | Sec. 2303.101. QUALIFICATION FOR ENTERPRISE ZONE |
|---|
| 17 | 17 | | DESIGNATION. An area automatically qualifies for designation as an |
|---|
| 18 | 18 | | enterprise zone if the area is: |
|---|
| 19 | 19 | | (1) a block group, as defined by the most recent |
|---|
| 20 | 20 | | federal decennial census available at the time of designation, in |
|---|
| 21 | 21 | | which at least 20 percent of the residents of the block group have |
|---|
| 22 | 22 | | an income at or below 100 percent of the federal poverty level; |
|---|
| 23 | 23 | | (2) an area designated by the federal government as a |
|---|
| 24 | 24 | | renewal community, a federal empowerment zone, or a federal |
|---|
| 25 | 25 | | enterprise community, including any developable area approved by |
|---|
| 26 | 26 | | the federal agency responsible for making that designation; [or] |
|---|
| 27 | 27 | | (3) an area located in a distressed county; or |
|---|
| 28 | 28 | | (4) an area inside the boundaries of a defense base |
|---|
| 29 | 29 | | development authority established under Chapter 379B, Local |
|---|
| 30 | 30 | | Government Code. |

| 31 | 31 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 35 | 35 | | Act takes effect September 1, 2013. |
