1010 relating to electronic voter registration.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 13, Election Code, is
1313 amended by adding Section 13.009 to read as follows:
1414 Sec. 13.009. ELECTRONIC VOTER REGISTRATION. (a) The
1515 secretary of state shall implement a program to allow a person to
1616 complete a voter registration application over the Internet from
1717 the official website of this state. The websites of the secretary
1818 of state and the Department of Public Safety must also provide a
1919 link to the location of the application on the official website of
2020 this state.
2121 (b) An applicant for electronic voter registration who has
2222 an unexpired driver's license or personal identification card
2323 issued in this state must:
2424 (1) attest to the truth of the information provided on
2525 the application by affirmatively accepting the information as true;
2626 and
2727 (2) affirmatively consent to the use of the signature
2828 on the applicant's driver's license or personal identification card
2929 for voter registration purposes.
3030 (c) An applicant for electronic voter registration who does
3131 not have an unexpired driver's license or personal identification
3232 card issued in this state must:
3333 (1) attest to the truth of the information provided on
3434 the application by affirmatively accepting the information as true;
3535 and
3636 (2) print a registration application from the website
3737 the applicant is using to register, sign the application, and mail
3838 it to the registrar.
3939 (d) For each application submitted under Subsection (b),
4040 the program shall require that a digital copy of the applicant's
4141 signature be obtained from the Department of Public Safety.
4242 (e) For each application submitted under Subsection (c),
4343 the program shall provide the applicant with:
4444 (1) a registration application that the applicant can
4545 print from the registration website, sign, and mail to the
4646 registrar as required under Subsection (c)(2); and
4747 (2) information about how the applicant can obtain a
4848 driver's license or personal identification card from the
4949 Department of Public Safety.
5050 (f) An application submitted under this section is
5151 considered for all purposes as an application submitted by mail
5252 under this title.
5353 (g) The secretary of state shall adopt rules as necessary to
5454 implement this section, including rules to provide for additional
5555 security measures necessary to ensure the accuracy and integrity of
5656 applications submitted electronically.
5757 (h) The rules adopted under Subsection (g) must require
5858 that:
5959 (1) the Internet website through which a person may
6060 complete a voter registration application include a description of
6161 the offense described by Section 13.007 in a conspicuous location
6262 on the website near the place where the person begins or submits the
6363 application; and
6464 (2) the state electronic Internet portal project be
6565 used to authenticate the identity of a person who submits an
6666 application electronically under this section.
6767 SECTION 2. This Act takes effect September 1, 2013.
