| 11 | 11 | | the Rio Grande Regional Water Authority. |

| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Sections 4.04(b) and (d), Chapter 385, Acts of |
|---|
| 14 | 14 | | the 78th Legislature, Regular Session, 2003, are amended to read as |
|---|
| 15 | 15 | | follows: |
|---|
| 16 | 16 | | (b) Each fiscal year, the board shall determine the amount |
|---|
| 17 | 17 | | of the fee or assessment based on the water rights held by the |
|---|
| 18 | 18 | | affected entity. The fee or assessment may not exceed five cents |
|---|
| 19 | 19 | | per acre-foot. |
|---|
| 20 | 20 | | (d) An initial fee or assessment imposed under this section |
|---|
| 21 | 21 | | may not exceed five cents per acre-foot for each water right held by |
|---|
| 22 | 22 | | the affected entity. |
|---|
| 23 | 23 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 24 | 24 | | a fee or assessment that is imposed by the Rio Grande Regional Water |
|---|
| 25 | 25 | | Authority on or after the effective date of this Act. A fee or |
|---|
| 26 | 26 | | assessment that is imposed before the effective date of this Act is |
|---|
| 27 | 27 | | governed by the law in effect when the fee or assessment was |
|---|
| 28 | 28 | | imposed, and the former law is continued in effect for that purpose. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2013. |
