1010 AN ACT
1111 relating to the Texas Statewide Mutual Aid System.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 418.115(a), Government Code, is amended
1414 to read as follows:
1515 (a) A request for mutual aid assistance may be submitted
1616 verbally or in writing. If a request is submitted verbally, it
1717 must be confirmed in writing [not later than the 30th day after the
1818 date the request was made].
1919 SECTION 2. Section 418.1181(a), Government Code, is amended
2020 to read as follows:
2121 (a) If a local government entity requests mutual aid
2222 assistance from another local government entity under the system
2323 that requires a response that exceeds 12 consecutive hours, the
2424 requesting local government entity shall reimburse the actual costs
2525 of providing mutual aid assistance to the responding local
2626 government entity, including costs for personnel, operation and
2727 maintenance of equipment, damaged equipment, food, lodging, and
2828 transportation, incurred by the responding local government entity
2929 in response to a request for reimbursement. Local government
3030 entities with a mutual aid agreement when the request for mutual aid
3131 assistance is made are subject to the agreement's terms of
3232 reimbursement, as provided by Section 418.111.
3333 SECTION 3. Section 418.114, Government Code, is repealed.
3434 SECTION 4. Sections 418.115(a) and 418.1181(a), Government
3535 Code, as amended by this Act, apply only to mutual aid assistance
3636 requested on or after the effective date of this Act. Mutual aid
3737 assistance requested before the effective date of this Act is
3838 governed by the law in effect on the date the aid was requested, and
3939 the former law is continued in effect for that purpose.
4040 SECTION 5. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2013.
