| 11 | 11 | | relating to the Texas Statewide Mutual Aid System. |

| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 418.115(a), Government Code, is amended |
|---|
| 14 | 14 | | to read as follows: |
|---|
| 15 | 15 | | (a) A request for mutual aid assistance may be submitted |
|---|
| 16 | 16 | | verbally or in writing. If a request is submitted verbally, it |
|---|
| 17 | 17 | | must be confirmed in writing [not later than the 30th day after the |
|---|
| 18 | 18 | | date the request was made]. |
|---|
| 19 | 19 | | SECTION 2. Section 418.1181(a), Government Code, is amended |
|---|
| 20 | 20 | | to read as follows: |
|---|
| 21 | 21 | | (a) If a local government entity requests mutual aid |
|---|
| 22 | 22 | | assistance from another local government entity under the system |
|---|
| 23 | 23 | | that requires a response that exceeds 12 consecutive hours, the |
|---|
| 24 | 24 | | requesting local government entity shall reimburse the actual costs |
|---|
| 25 | 25 | | of providing mutual aid assistance to the responding local |
|---|
| 26 | 26 | | government entity, including costs for personnel, operation and |
|---|
| 27 | 27 | | maintenance of equipment, damaged equipment, food, lodging, and |
|---|
| 28 | 28 | | transportation, incurred by the responding local government entity |
|---|
| 29 | 29 | | in response to a request for reimbursement. Local government |
|---|
| 30 | 30 | | entities with a mutual aid agreement when the request for mutual aid |
|---|
| 31 | 31 | | assistance is made are subject to the agreement's terms of |
|---|
| 32 | 32 | | reimbursement, as provided by Section 418.111. |
|---|
| 33 | 33 | | SECTION 3. Section 418.114, Government Code, is repealed. |
|---|
| 34 | 34 | | SECTION 4. Sections 418.115(a) and 418.1181(a), Government |
|---|
| 35 | 35 | | Code, as amended by this Act, apply only to mutual aid assistance |
|---|
| 36 | 36 | | requested on or after the effective date of this Act. Mutual aid |
|---|
| 37 | 37 | | assistance requested before the effective date of this Act is |
|---|
| 38 | 38 | | governed by the law in effect on the date the aid was requested, and |
|---|
| 39 | 39 | | the former law is continued in effect for that purpose. |
|---|
| 40 | 40 | | SECTION 5. This Act takes effect immediately if it receives |
|---|
| 41 | 41 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 42 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 43 | 43 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 44 | 44 | | Act takes effect September 1, 2013. |
