| 11 | 11 | | relating to instruction and continuing education requirements for |

| 12 | 12 | | certain court clerks. |

| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Sections 51.605(b) and (c), Government Code, are |
|---|
| 15 | 15 | | amended to read as follows: |
|---|
| 16 | 16 | | (b) A clerk shall complete 20 hours of instruction regarding |
|---|
| 17 | 17 | | the performance of the clerk's duties of office before the first |
|---|
| 18 | 18 | | anniversary of the date the clerk assumes those duties [during each |
|---|
| 19 | 19 | | calendar year that begins after the clerk's election or appointment |
|---|
| 20 | 20 | | to office]. |

| 21 | 21 | | (c) After the first anniversary of the date a clerk assumes |
|---|
| 22 | 22 | | the duties of office, the [A] clerk must each calendar year |
|---|
| 23 | 23 | | complete 20 hours of continuing education courses. [A clerk must, |

| 24 | 24 | | during the first year of each term of office, complete: |
|---|
| 25 | 25 | | [(1) at least one hour of continuing education courses |

| 26 | 26 | | regarding registry funds handled under Chapter 117, Local |

| 27 | 27 | | Government Code, in the performance of the duties of office; and |

| 28 | 28 | | [(2) at least one hour of continuing education courses |

| 29 | 29 | | regarding fraudulent court documents and fraudulent document |
|---|
| 30 | 30 | | filings.] |

| 31 | 31 | | SECTION 2. Section 51.605(b), Government Code, as amended |
|---|
| 32 | 32 | | by this Act, applies to a court clerk who assumes the duties of |
|---|
| 33 | 33 | | office on or after the effective date of this Act. A court clerk who |
|---|
| 34 | 34 | | assumes the duties of office before that date is governed by the law |
|---|
| 35 | 35 | | in effect immediately before the effective date of this Act, and |
|---|
| 36 | 36 | | that law is continued in effect for that purpose. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 38 | 38 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 39 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 40 | 40 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 41 | 41 | | Act takes effect September 1, 2013. |
