99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to instruction and continuing education requirements for
1212 certain court clerks.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Sections 51.605(b) and (c), Government Code, are
1515 amended to read as follows:
1616 (b) A clerk shall complete 20 hours of instruction regarding
1717 the performance of the clerk's duties of office before the first
1818 anniversary of the date the clerk assumes those duties [during each
1919 calendar year that begins after the clerk's election or appointment
2020 to office].
2121 (c) After the first anniversary of the date a clerk assumes
2222 the duties of office, the [A] clerk must each calendar year
2323 complete 20 hours of continuing education courses. [A clerk must,
2424 during the first year of each term of office, complete:
2525 [(1) at least one hour of continuing education courses
2626 regarding registry funds handled under Chapter 117, Local
2727 Government Code, in the performance of the duties of office; and
2828 [(2) at least one hour of continuing education courses
2929 regarding fraudulent court documents and fraudulent document
3030 filings.]
3131 SECTION 2. Section 51.605(b), Government Code, as amended
3232 by this Act, applies to a court clerk who assumes the duties of
3333 office on or after the effective date of this Act. A court clerk who
3434 assumes the duties of office before that date is governed by the law
3535 in effect immediately before the effective date of this Act, and
3636 that law is continued in effect for that purpose.
3737 SECTION 3. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect September 1, 2013.
