| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Chapter 2155, Occupations Code, is amended by |
|---|
| 14 | 14 | | adding Subchapter C to read as follows: |
|---|
| 15 | 15 | | SUBCHAPTER C. FIREARMS POLICY NOTICE |
|---|
| 16 | 16 | | Sec. 2155.101. DEFINITION. In this subchapter, "hotel" has |
|---|
| 17 | 17 | | the meaning assigned by Section 156.001, Tax Code. |
|---|
| 18 | 18 | | Sec. 2155.102. APPLICABILITY OF SUBCHAPTER. This subchapter |
|---|
| 19 | 19 | | applies only to a hotel that has a policy prohibiting or restricting |
|---|
| 20 | 20 | | the possession, storage, or transportation of firearms by hotel |
|---|
| 21 | 21 | | guests. |
|---|
| 22 | 22 | | Sec. 2155.103. NOTICE REGARDING FIREARMS POLICY. (a) A |
|---|
| 23 | 23 | | hotel shall include on the hotel's Internet reservation website the |
|---|
| 24 | 24 | | hotel's policy regarding the possession, storage, and |
|---|
| 25 | 25 | | transportation of firearms. |
|---|
| 26 | 26 | | (b) If a hotel provides a written confirmation or a written |
|---|
| 27 | 27 | | statement of terms and conditions to a consumer after accepting the |
|---|
| 28 | 28 | | consumer's hotel reservation by telephone, the hotel shall include |
|---|
| 29 | 29 | | information specifying how the consumer may review applicable guest |
|---|
| 30 | 30 | | policies. The guest policies must indicate the hotel's policy |
|---|
| 31 | 31 | | regarding the possession, storage, and transportation of firearms |
|---|
| 32 | 32 | | by guests. |
|---|
| 33 | 33 | | (c) A hotel owner or keeper commits an offense if the person |
|---|
| 34 | 34 | | does not comply with this section. An offense under this subsection |
|---|
| 35 | 35 | | is a misdemeanor punishable by a fine of not more than $100. |
|---|
| 36 | 36 | | SECTION 2. This Act takes effect September 1, 2013. |
