1010 relating to requiring notice of a hotel's firearms policy and other
1111 guest policies; providing a criminal penalty.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Chapter 2155, Occupations Code, is amended by
1414 adding Subchapter C to read as follows:
1515 SUBCHAPTER C. FIREARMS POLICY NOTICE
1616 Sec. 2155.101. DEFINITION. In this subchapter, "hotel" has
1717 the meaning assigned by Section 156.001, Tax Code.
1818 Sec. 2155.102. APPLICABILITY OF SUBCHAPTER. This subchapter
1919 applies only to a hotel that has a policy prohibiting or restricting
2020 the possession, storage, or transportation of firearms by hotel
2121 guests.
2222 Sec. 2155.103. NOTICE REGARDING FIREARMS POLICY. (a) A
2323 hotel shall include on the hotel's Internet reservation website the
2424 hotel's policy regarding the possession, storage, and
2525 transportation of firearms.
2626 (b) If a hotel provides a written confirmation or a written
2727 statement of terms and conditions to a consumer after accepting the
2828 consumer's hotel reservation by telephone, the hotel shall include
2929 information specifying how the consumer may review applicable guest
3030 policies. The guest policies must indicate the hotel's policy
3131 regarding the possession, storage, and transportation of firearms
3232 by guests.
3333 (c) A hotel owner or keeper commits an offense if the person
3434 does not comply with this section. An offense under this subsection
3535 is a misdemeanor punishable by a fine of not more than $100.
3636 SECTION 2. This Act takes effect September 1, 2013.
