1010 relating to junior college district territory annexation and
1111 program approval in certain counties.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 130.063, Education Code, is amended by
1414 amending Subsection (d) and adding Subsection (e) to read as
1515 follows:
1616 (d) Except as provided by Subsection (e), a [A] junior
1717 college district may not annex territory under this section if a
1818 campus of the Texas State Technical College System is located:
1919 (1) within the county in which the territory is
2020 located; and
2121 (2) outside the junior college district.
2222 (e) This section does not prevent a junior college district
2323 from annexing territory located in Brown County.
2424 SECTION 2. Section 135.04(b), Education Code, is amended to
2525 read as follows:
2626 (b) Before any program may be offered by a campus or
2727 extension center within the tax district of a public junior college
2828 that is operating a vocational and technical program, it must be
2929 established that the public junior college is not capable of
3030 offering or is unable to offer the program. After it is established
3131 that a need for the program exists and that the program is not
3232 locally available, the campus or extension center may offer the
3333 program, provided approval is secured from the coordinating board.
3434 Approval of technical-vocational programs under this section does
3535 not apply to Brown, McLennan, Cameron, and Potter counties.
3636 SECTION 3. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2013.
