9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter A, Chapter 141, Election Code, is | |
11 | 11 | amended by adding Section 141.005 to read as follows: | |
12 | 12 | Sec. 141.005. RESIDENCY REQUIREMENT IN CERTAIN POLITICAL | |
13 | 13 | SUBDIVISIONS. (a) This section applies only to a political | |
14 | 14 | subdivision that: | |
15 | 15 | (1) is located in a county with territory greater than | |
16 | 16 | 4,600 square miles; and | |
17 | 17 | (2) is either: | |
18 | 18 | (A) an independent school district servicing | |
19 | 19 | fewer than 1,500 students; or | |
20 | 20 | (B) a municipality with a population of less than | |
21 | 21 | 6,000. | |
22 | 22 | (b) Notwithstanding Section 141.001, a municipal charter | |
23 | 23 | provision, or any other law, a candidate for the governing body of | |
24 | 24 | an independent school district or a municipality is eligible for | |
25 | 25 | any position of the governing body if the candidate resides | |
26 | 26 | anywhere in the territory from which any member of the governing | |
27 | 27 | body is elected. | |
28 | 28 | SECTION 2. This Act takes effect September 1, 2013. |
