77 relating to the residency requirement for certain elective offices

99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 141, Election Code, is
1111 amended by adding Section 141.005 to read as follows:
1212 Sec. 141.005. RESIDENCY REQUIREMENT IN CERTAIN POLITICAL
1313 SUBDIVISIONS. (a) This section applies only to a political
1414 subdivision that:
1515 (1) is located in a county with territory greater than
1616 4,600 square miles; and
1717 (2) is either:
1818 (A) an independent school district servicing
1919 fewer than 1,500 students; or
2020 (B) a municipality with a population of less than
2121 6,000.
2222 (b) Notwithstanding Section 141.001, a municipal charter
2323 provision, or any other law, a candidate for the governing body of
2424 an independent school district or a municipality is eligible for
2525 any position of the governing body if the candidate resides
2626 anywhere in the territory from which any member of the governing
2727 body is elected.
2828 SECTION 2. This Act takes effect September 1, 2013.
