99 AN ACT
1010 relating to nutrition and wellness education for certain recipients
1111 of certain state benefits.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1414 amended by adding Section 531.0995 to read as follows:
1515 Sec. 531.0995. NUTRITION AND WELLNESS EDUCATION. (a) This
1616 section applies to individuals receiving benefits under:
1717 (1) the financial assistance program under Chapter 31,
1818 Human Resources Code;
1919 (2) the medical assistance program under Chapter 32,
2020 Human Resources Code; or
2121 (3) the supplemental nutrition assistance program
2222 under Chapter 33, Human Resources Code.
2323 (b) The commission shall work with community-based
2424 organizations to encourage individuals receiving benefits to
2525 access readily available and existing online information and
2626 programs, including information provided on the commission's
2727 website, that provide nutrition and wellness education for the
2828 purpose of promoting healthy eating habits and a physically active
2929 lifestyle.
3030 (c) Not later than January 1, 2015, the commission shall
3131 report to the legislature on the use of nutrition and wellness
3232 education information provided on the commission's website. The
3333 report must include:
3434 (1) feedback from clients on the effectiveness of the
3535 information accessed; and
3636 (2) any available data on the number of individuals
3737 who accessed the information.
3838 (d) The executive commissioner may adopt rules to implement
3939 this section.
4040 (e) This section expires September 1, 2015.
4141 SECTION 2. If before implementing any provision of this Act
4242 a state agency determines that a waiver or authorization from a
4343 federal agency is necessary for implementation of that provision,
4444 the agency affected by the provision shall request the waiver or
4545 authorization and may delay implementing that provision until the
4646 waiver or authorization is granted.
4747 SECTION 3. This Act takes effect September 1, 2013.
