| 14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 15 | | SECTION 1. Subchapter B, Chapter 42, Local Government Code, |
|---|
| 16 | 16 | | is amended by adding Section 42.0252 to read as follows: |
|---|
| 17 | 17 | | Sec. 42.0252. RELEASE OF EXTRATERRITORIAL JURISDICTION |
|---|
| 18 | 18 | | EXTENDING ACROSS SHIP CHANNEL. (a) A municipality with an |
|---|
| 19 | 19 | | extraterritorial jurisdiction of five miles that extends across a |
|---|
| 20 | 20 | | ship channel shall release from its extraterritorial jurisdiction |
|---|
| 21 | 21 | | any strip of land less than one mile in width that lies entirely |
|---|
| 22 | 22 | | between the edge of the ship channel and the municipal boundary of a |
|---|
| 23 | 23 | | second municipality whose extraterritorial jurisdiction would |
|---|
| 24 | 24 | | include the strip if not for its inclusion in the first |
|---|
| 25 | 25 | | municipality's jurisdiction. |
|---|
| 26 | 26 | | (b) On the release from the extraterritorial jurisdiction |
|---|
| 27 | 27 | | of a municipality under Subsection (a), the released area becomes |
|---|
| 28 | 28 | | part of the extraterritorial jurisdiction of the second |
|---|
| 29 | 29 | | municipality to the extent described by Section 42.021. |
|---|
| 30 | 30 | | (c) This section does not apply to: |
|---|
| 31 | 31 | | (1) a municipality with a population of more than |
|---|
| 32 | 32 | | 300,000 that is located in a county that borders the Gulf of Mexico; |
|---|
| 33 | 33 | | or |
|---|
| 34 | 34 | | (2) a municipality with a population of more than two |
|---|
| 35 | 35 | | million. |
|---|
| 36 | 36 | | (d) This section does not affect the rights of a navigation |
|---|
| 37 | 37 | | district located in the extraterritorial jurisdiction of a |
|---|
| 38 | 38 | | municipality described by Subsection (a). |
|---|
| 39 | 39 | | SECTION 2. This Act takes effect September 1, 2013. |
