1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to the release of extraterritorial jurisdiction by certain
1313 municipalities.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Subchapter B, Chapter 42, Local Government Code,
1616 is amended by adding Section 42.0252 to read as follows:
1717 Sec. 42.0252. RELEASE OF EXTRATERRITORIAL JURISDICTION
1818 EXTENDING ACROSS SHIP CHANNEL. (a) A municipality with an
1919 extraterritorial jurisdiction of five miles that extends across a
2020 ship channel shall release from its extraterritorial jurisdiction
2121 any strip of land less than one mile in width that lies entirely
2222 between the edge of the ship channel and the municipal boundary of a
2323 second municipality whose extraterritorial jurisdiction would
2424 include the strip if not for its inclusion in the first
2525 municipality's jurisdiction.
2626 (b) On the release from the extraterritorial jurisdiction
2727 of a municipality under Subsection (a), the released area becomes
2828 part of the extraterritorial jurisdiction of the second
2929 municipality to the extent described by Section 42.021.
3030 (c) This section does not apply to:
3131 (1) a municipality with a population of more than
3232 300,000 that is located in a county that borders the Gulf of Mexico;
3333 or
3434 (2) a municipality with a population of more than two
3535 million.
3636 (d) This section does not affect the rights of a navigation
3737 district located in the extraterritorial jurisdiction of a
3838 municipality described by Subsection (a).
3939 SECTION 2. This Act takes effect September 1, 2013.
