| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 16.055, Water Code, is amended by |
|---|
| 14 | 14 | | amending Subsection (h) and adding Subsection (j) to read as |
|---|
| 15 | 15 | | follows: |
|---|
| 16 | 16 | | (h) On receipt of the notice under Subsection (g)(2)(B), the |
|---|
| 17 | 17 | | person or entity shall immediately implement the person's or |
|---|
| 18 | 18 | | entity's water conservation plan and [or] drought contingency plan, |
|---|
| 19 | 19 | | as applicable. |
|---|
| 20 | 20 | | (j) The board may notify the commission if the board |
|---|
| 21 | 21 | | determines that a person or entity has violated Subsection (h). |
|---|
| 22 | 22 | | Notwithstanding Section 7.051(b), a violation of Subsection (h) is |
|---|
| 23 | 23 | | enforceable in the manner provided by Chapter 7 for a violation of a |
|---|
| 24 | 24 | | provision of this code within the commission's jurisdiction or of a |
|---|
| 25 | 25 | | rule adopted by the commission under a provision of this code within |
|---|
| 26 | 26 | | the commission's jurisdiction. |
|---|
| 27 | 27 | | SECTION 2. This Act takes effect September 1, 2013. |
