99 relating to a requirement that members of the Public Safety
1010 Commission hold a secret security clearance.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 411.003(b), Government Code, is amended
1313 to read as follows:
1414 (b) The commission is composed of five citizens of this
1515 state appointed by the governor with the advice and consent of the
1616 senate. Members must be selected because of their peculiar
1717 qualifications for the position and must reflect the diverse
1818 geographic regions and population groups of this state. Members
1919 must have and maintain a secret security clearance granted by the
2020 United States government. Appointments to the commission shall be
2121 made without regard to race, color, disability, sex, religion, age,
2222 or national origin. In making an appointment the governor shall
2323 consider, among other things, the person's knowledge of laws,
2424 experience in the enforcement of law, honesty, integrity,
2525 education, training, and executive ability.
2626 SECTION 2. The changes in law made by this Act apply to a
2727 member of the Public Safety Commission serving on or after the
2828 effective date of this Act.
2929 SECTION 3. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2013.
