99 AN ACT
1010 relating to licensing requirements for newly constructed assisted
1111 living facilities.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 247.021(g), Health and Safety Code, is
1414 amended to read as follows:
1515 (g) The department shall, upon submission of a written
1616 request by the applicant, automatically issue a six-month
1717 provisional license without conducting a life safety code
1818 inspection before issuance of the provisional license to a newly
1919 constructed facility if:
2020 (1) the license applicant has submitted building plans
2121 to the department for an early compliance review in accordance with
2222 Section 247.0261 [facility is in compliance with resident care
2323 standards];
2424 (2) all local approvals, including a certificate of
2525 occupancy where required, have been obtained;
2626 (3) a complete license application form is submitted
2727 within 30 days of receipt of all local approvals;
2828 (4) the license fee has been paid;
2929 (5) [before beginning construction, the license
3030 applicant submits working drawings and specifications to the
3131 department for review; and
3232 [(6)] the department determines that the license
3333 applicant or a person who owns the license applicant and controls
3434 the operations of the license applicant constructed another
3535 facility in this state that complies with the department's life
3636 safety code standards; and
3737 (6) the facility is in compliance with resident care
3838 standards based on an on-site health inspection.
3939 SECTION 2. This Act takes effect September 1, 2013.
