99 relating to county expenditures for certain health care services.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 61.036, Health and Safety Code, is
1212 amended by adding Subsections (d) and (e) to read as follows:
1313 (d) Regardless of the application, documentation, and
1414 verification procedures or eligibility standards established by
1515 the department under Subchapter A, a county may credit an
1616 intergovernmental transfer to the state toward eligibility for
1717 state assistance if the transfer was made:
1818 (1) to provide health care services as part of a waiver
1919 program under 42 U.S.C. Section 1315 or 1396n; or
2020 (2) as part of the state plan for disproportionate
2121 share hospitals under 42 U.S.C. Section 1396r-4 or 1 T.A.C. Section
2222 355.8065.
2323 (e) A county may not credit toward eligibility for state
2424 assistance any intergovernmental transfer made under Subsection
2525 (d)(1) or (2) that, separately or in combination, exceeds six
2626 percent of the county's general revenue levy in any state fiscal
2727 year.
2828 SECTION 2. (a) The change in law made by this Act to
2929 Section 61.036, Health and Safety Code, applies only to state
3030 assistance for health care services under Chapter 61, Health and
3131 Safety Code, as amended by this Act, that are delivered on or after
3232 the effective date of this Act.
3333 (b) State assistance for health care services under Chapter
3434 61, Health and Safety Code, that are delivered before the effective
3535 date of this Act is governed by the law as it existed immediately
3636 before the effective date of this Act, and that law is continued in
3737 effect for that purpose.
3838 SECTION 3. This Act takes effect immediately if it receives
3939 a vote of two-thirds of all the members elected to each house, as
4040 provided by Section 39, Article III, Texas Constitution. If this
4141 Act does not receive the vote necessary for immediate effect, this
4242 Act takes effect September 1, 2013.
