| 9 | 9 | | relating to county expenditures for certain health care services. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 61.036, Health and Safety Code, is |
|---|
| 12 | 12 | | amended by adding Subsections (d) and (e) to read as follows: |
|---|
| 13 | 13 | | (d) Regardless of the application, documentation, and |
|---|
| 14 | 14 | | verification procedures or eligibility standards established by |
|---|
| 15 | 15 | | the department under Subchapter A, a county may credit an |
|---|
| 16 | 16 | | intergovernmental transfer to the state toward eligibility for |
|---|
| 17 | 17 | | state assistance if the transfer was made: |
|---|
| 18 | 18 | | (1) to provide health care services as part of a waiver |
|---|
| 19 | 19 | | program under 42 U.S.C. Section 1315 or 1396n; or |
|---|
| 20 | 20 | | (2) as part of the state plan for disproportionate |
|---|
| 21 | 21 | | share hospitals under 42 U.S.C. Section 1396r-4 or 1 T.A.C. Section |
|---|
| 22 | 22 | | 355.8065. |
|---|
| 23 | 23 | | (e) A county may not credit toward eligibility for state |
|---|
| 24 | 24 | | assistance any intergovernmental transfer made under Subsection |
|---|
| 25 | 25 | | (d)(1) or (2) that, separately or in combination, exceeds six |
|---|
| 26 | 26 | | percent of the county's general revenue levy in any state fiscal |
|---|
| 27 | 27 | | year. |
|---|
| 28 | 28 | | SECTION 2. (a) The change in law made by this Act to |
|---|
| 29 | 29 | | Section 61.036, Health and Safety Code, applies only to state |
|---|
| 30 | 30 | | assistance for health care services under Chapter 61, Health and |
|---|
| 31 | 31 | | Safety Code, as amended by this Act, that are delivered on or after |
|---|
| 32 | 32 | | the effective date of this Act. |
|---|
| 33 | 33 | | (b) State assistance for health care services under Chapter |
|---|
| 34 | 34 | | 61, Health and Safety Code, that are delivered before the effective |
|---|
| 35 | 35 | | date of this Act is governed by the law as it existed immediately |
|---|
| 36 | 36 | | before the effective date of this Act, and that law is continued in |
|---|
| 37 | 37 | | effect for that purpose. |
|---|
| 38 | 38 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 39 | 39 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 40 | 40 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 41 | 41 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 42 | 42 | | Act takes effect September 1, 2013. |
