1010 relating to expenditures made by emergency services districts.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 775.073, Health and Safety Code, is
1313 amended to read as follows:
1414 Sec. 775.073. EXPENDITURES [METHOD OF PAYMENT]. (a)
1515 Except as otherwise provided by this section, district [District]
1616 funds may be disbursed only by check, draft, order, or other
1717 instrument that:
1818 (1) is signed by at least a majority of the board's
1919 commissioners; or
2020 (2) is signed by the treasurer and countersigned by
2121 the president. [If the treasurer is absent or unavailable, the
2222 assistant treasurer may sign for the treasurer. If the president is
2323 absent or unavailable, the vice president may sign for the
2424 president.]
2525 (b) The board by resolution may allow a district employee
2626 who has executed a bond in an amount equal to the amount required
2727 for the district treasurer to sign an instrument to disburse
2828 district funds. An expenditure of more than $2,000 may not be paid
2929 [from tax money] unless [a sworn itemized account covering] the
3030 expenditure is presented to the board and the board approves the
3131 expenditure.
3232 (c) The board may authorize the disbursement of district
3333 funds transferred by federal reserve wire system. The board by
3434 resolution may authorize wire transfers to accounts in the
3535 district's name or accounts not in the district's name.
3636 (d) Any property, including an interest in property,
3737 purchased or leased using district funds, wholly or partly, must
3838 remain the property of the district, regardless of whether the
3939 property is used by a third party under a contract for services or
4040 otherwise, until:
4141 (1) the property is sold to a third party following the
4242 procedures authorized under Section 263.003, 263.007, or 263.008,
4343 Local Government Code; or
4444 (2) the property is disposed of in accordance with
4545 Subchapter J.
4646 SECTION 2. This Act takes effect September 1, 2013.
