99 relating to the powers and duties of the Montgomery County Water
1010 Control and Improvement District No. 3.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 9040, Special District
1313 Local Laws Code, is amended by adding Section 9040.105 to read as
1414 follows:
1515 Sec. 9040.105. POWERS AND DUTIES RELATED TO FILL PROJECTS.
1616 (a) The district has the powers and duties provided by the general
1717 law of this state, including Chapters 49 and 57, Water Code,
1818 applicable to levee improvement districts created under Section 59,
1919 Article XVI, Texas Constitution.
2020 (b) The district may:
2121 (1) reclaim land in the district; and
2222 (2) construct works, facilities, and improvements
2323 necessary to accomplish that purpose.
2424 (c) The district may finance and contract for the
2525 construction of a fill project or for the acquisition of land for a
2626 fill project in the district, including drainage and reclamation.
2727 (d) For the district's exercise of a power of or performance
2828 of a duty of a levee improvement district as provided by Subsection
2929 (c), the Texas Commission on Environmental Quality shall consider
3030 the district to be a levee improvement district.
3131 (e) For any fill or levee project located in the district
3232 and in the watershed of the San Jacinto River Basin, the district
3333 shall obtain approval for the plan from any state or federal agency
3434 with jurisdiction to permit a project of the same type and from any
3535 municipality with a right to divert state water from a point located
3636 between the district and Lake Houston.
3737 SECTION 2. (a) The legal notice of the intention to
3838 introduce this Act, setting forth the general substance of this
3939 Act, has been published as provided by law, and the notice and a
4040 copy of this Act have been furnished to all persons, agencies,
4141 officials, or entities to which they are required to be furnished
4242 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
4343 Government Code.
4444 (b) The governor, one of the required recipients, has
4545 submitted the notice and Act to the Texas Commission on
4646 Environmental Quality.
4747 (c) The Texas Commission on Environmental Quality has filed
4848 its recommendations relating to this Act with the governor, the
4949 lieutenant governor, and the speaker of the house of
5050 representatives within the required time.
5151 (d) All requirements of the constitution and laws of this
5252 state and the rules and procedures of the legislature with respect
5353 to the notice, introduction, and passage of this Act are fulfilled
5454 and accomplished.
5555 SECTION 3. This Act takes effect immediately if it receives
5656 a vote of two-thirds of all the members elected to each house, as
5757 provided by Section 39, Article III, Texas Constitution. If this
5858 Act does not receive the vote necessary for immediate effect, this
5959 Act takes effect September 1, 2013.
