77 relating to the administration, powers, and duties of the Fort Bend
88 County Municipal Utility District No. 134.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2.01(a), Chapter 1342, Acts of the 77th
1111 Legislature, Regular Session, 2001, is amended to read as follows:
1212 (a) The district is governed by a board of five directors
1313 [elected as provided by Section 2.04].
1414 SECTION 2. Section 3.015(a), Chapter 1342, Acts of the 77th
1515 Legislature, Regular Session, 2001, is amended to read as follows:
1616 (a) To the extent authorized by Section 52, Article III,
1717 Texas Constitution, the district may construct, acquire, improve,
1818 maintain, or operate macadamized, graveled, or paved roads or
1919 turnpikes, or improvements in aid of those roads or turnpikes,
2020 including entrance and exit ramps to and from State Highway 99, also
2121 known as the Grand Parkway [inside the district].
2222 SECTION 3. The heading to Section 7.03, Chapter 1342, Acts
2323 of the 77th Legislature, Regular Session, 2001, is amended to read
2424 as follows:
2525 Sec. 7.03. LAW GOVERNING DIVIDED DISTRICT; APPOINTMENT AND
2626 ELECTION OF DIRECTORS.
2727 SECTION 4. Sections 7.03(a) and (e), Chapter 1342, Acts of
2828 the 77th Legislature, Regular Session, 2001, are amended to read as
2929 follows:
3030 (a) A district resulting from a division under this article
3131 is a separate district and is governed as a separate district. This
3232 Act applies to any new district created by the division of the
3333 district, and a new district has all the powers and duties of the
3434 district.
3535 (e) Members of a [A] successor to the board of directors of a
3636 district resulting from a division under this article shall be
3737 elected as provided by Section 49.103, Water Code [2.04 of this
3838 Act].
3939 SECTION 5. The following sections of Chapter 1342, Acts of
4040 the 77th Legislature, Regular Session, 2001, are repealed:
4141 (1) Section 2.01(c);
4242 (2) Section 2.04;
4343 (3) Section 2.05(b);
4444 (4) Section 2.10;
4545 (5) Section 5.05; and
4646 (6) Section 9.02.
4747 SECTION 6. (a) The legal notice of the intention to
4848 introduce this Act, setting forth the general substance of this
4949 Act, has been published as provided by law, and the notice and a
5050 copy of this Act have been furnished to all persons, agencies,
5151 officials, or entities to which they are required to be furnished
5252 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
5353 Government Code.
5454 (b) The governor, one of the required recipients, has
5555 submitted the notice and Act to the Texas Commission on
5656 Environmental Quality.
5757 (c) The Texas Commission on Environmental Quality has filed
5858 its recommendations relating to this Act with the governor, the
5959 lieutenant governor, and the speaker of the house of
6060 representatives within the required time.
6161 (d) All requirements of the constitution and laws of this
6262 state and the rules and procedures of the legislature with respect
6363 to the notice, introduction, and passage of this Act are fulfilled
6464 and accomplished.
6565 SECTION 7. This Act takes effect immediately if it receives
6666 a vote of two-thirds of all the members elected to each house, as
6767 provided by Section 39, Article III, Texas Constitution. If this
6868 Act does not receive the vote necessary for immediate effect, this
6969 Act takes effect September 1, 2013.
