7	7	relating to the administration, powers, and duties of the Fort Bend
8	8	County Municipal Utility District No. 134.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 2.01(a), Chapter 1342, Acts of the 77th
11	11	Legislature, Regular Session, 2001, is amended to read as follows:
12	12	(a) The district is governed by a board of five directors
13	13	[elected as provided by Section 2.04].
14	14	SECTION 2. Section 3.015(a), Chapter 1342, Acts of the 77th
15	15	Legislature, Regular Session, 2001, is amended to read as follows:
16	16	(a) To the extent authorized by Section 52, Article III,
17	17	Texas Constitution, the district may construct, acquire, improve,
18	18	maintain, or operate macadamized, graveled, or paved roads or
19	19	turnpikes, or improvements in aid of those roads or turnpikes,
20	20	including entrance and exit ramps to and from State Highway 99, also
21	21	known as the Grand Parkway [inside the district].
22	22	SECTION 3. The heading to Section 7.03, Chapter 1342, Acts
23	23	of the 77th Legislature, Regular Session, 2001, is amended to read
24	24	as follows:
25	25	Sec. 7.03. LAW GOVERNING DIVIDED DISTRICT; APPOINTMENT AND
26	26	ELECTION OF DIRECTORS.
27	27	SECTION 4. Sections 7.03(a) and (e), Chapter 1342, Acts of
28	28	the 77th Legislature, Regular Session, 2001, are amended to read as
29	29	follows:
30	30	(a) A district resulting from a division under this article
31	31	is a separate district and is governed as a separate district. This
32	32	Act applies to any new district created by the division of the
33	33	district, and a new district has all the powers and duties of the
34	34	district.
35	35	(e) Members of a [A] successor to the board of directors of a
36	36	district resulting from a division under this article shall be
37	37	elected as provided by Section 49.103, Water Code [2.04 of this
38	38	Act].
39	39	SECTION 5. The following sections of Chapter 1342, Acts of
40	40	the 77th Legislature, Regular Session, 2001, are repealed:
41	41	(1) Section 2.01(c);
42	42	(2) Section 2.04;
43	43	(3) Section 2.05(b);
44	44	(4) Section 2.10;
45	45	(5) Section 5.05; and
46	46	(6) Section 9.02.
47	47	SECTION 6. (a) The legal notice of the intention to
48	48	introduce this Act, setting forth the general substance of this
49	49	Act, has been published as provided by law, and the notice and a
50	50	copy of this Act have been furnished to all persons, agencies,
51	51	officials, or entities to which they are required to be furnished
52	52	under Section 59, Article XVI, Texas Constitution, and Chapter 313,
53	53	Government Code.
54	54	(b) The governor, one of the required recipients, has
55	55	submitted the notice and Act to the Texas Commission on
56	56	Environmental Quality.
57	57	(c) The Texas Commission on Environmental Quality has filed
58	58	its recommendations relating to this Act with the governor, the
59	59	lieutenant governor, and the speaker of the house of
60	60	representatives within the required time.
61	61	(d) All requirements of the constitution and laws of this
62	62	state and the rules and procedures of the legislature with respect
63	63	to the notice, introduction, and passage of this Act are fulfilled
64	64	and accomplished.
65	65	SECTION 7. This Act takes effect immediately if it receives
66	66	a vote of two-thirds of all the members elected to each house, as
67	67	provided by Section 39, Article III, Texas Constitution. If this
68	68	Act does not receive the vote necessary for immediate effect, this
69	69	Act takes effect September 1, 2013.
