| 10 | 10 | | relating to the annexation of certain territory by the Wise County |

| 11 | 11 | | Water Control and Improvement District No. 1. |

| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. DEFINITIONS. In this Act: |
|---|
| 14 | 14 | | (1) "Board" means the district's board of directors. |
|---|
| 15 | 15 | | (2) "District" means the Wise County Water Control and |
|---|
| 16 | 16 | | Improvement District No. 1. |
|---|
| 17 | 17 | | SECTION 2. ANNEXATION OF TERRITORY IN WISE COUNTY. (a) The |
|---|
| 18 | 18 | | board may call an election in Wise County to authorize the |
|---|
| 19 | 19 | | district's annexation of all parts of Wise County not within the |
|---|
| 20 | 20 | | district's boundaries on the effective date of this Act. |
|---|
| 21 | 21 | | (b) The board may order the annexation and an election to |
|---|
| 22 | 22 | | approve the annexation based on a resolution of the board with or |
|---|
| 23 | 23 | | without a petition requesting the annexation. |
|---|
| 24 | 24 | | (c) Except as provided by Subsection (b) of this section, |
|---|
| 25 | 25 | | the annexation of territory and an election under this section must |
|---|
| 26 | 26 | | conform to the requirements of Section 49.302, Water Code, |
|---|
| 27 | 27 | | including any hearing and notice requirements. |
|---|
| 28 | 28 | | (d) The ballot for an election under this section must be |
|---|
| 29 | 29 | | printed to provide for voting for or against: |
|---|
| 30 | 30 | | (1) the annexation of the territory; and |
|---|
| 31 | 31 | | (2) the assumption by the territory proposed to be |
|---|
| 32 | 32 | | annexed of its proportionate share of any outstanding debt of the |
|---|
| 33 | 33 | | district. |
|---|
| 34 | 34 | | SECTION 3. EFFECTIVE DATE. This Act takes effect |
|---|
| 35 | 35 | | immediately if it receives a vote of two-thirds of all the members |
|---|
| 36 | 36 | | elected to each house, as provided by Section 39, Article III, Texas |
|---|
| 37 | 37 | | Constitution. If this Act does not receive the vote necessary for |
|---|
| 38 | 38 | | immediate effect, this Act takes effect September 1, 2013. |
