7 | 7 | | relating to reporting requirements and other information in |

8 | 8 | | connection with an award under the Texas emerging technology fund. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 490.005(b), Government Code, is amended |
---|
11 | 11 | | to read as follows: |
---|
12 | 12 | | (b) The annual report must also contain: |
---|
13 | 13 | | (1) the aggregate total number of jobs actually |
---|
14 | 14 | | created by all projects [each project] receiving funding under this |
---|
15 | 15 | | chapter; |
---|
16 | 16 | | (2) an analysis of the number of jobs actually created |
---|
17 | 17 | | by all projects [each project] receiving funding under this |
---|
18 | 18 | | chapter; and |
---|
19 | 19 | | (3) a brief description regarding: |
---|
20 | 20 | | (A) the methodology used to determine the |
---|
21 | 21 | | information provided under Subdivisions (1) and (2), which may be |
---|
22 | 22 | | developed in consultation with the comptroller's office; |
---|
23 | 23 | | (B) the intended outcomes of projects funded |
---|
24 | 24 | | under Subchapter D during each preceding state fiscal year; and |
---|
25 | 25 | | (C) the actual outcomes of all projects funded |
---|
26 | 26 | | under Subchapter D during each preceding state fiscal year, |
---|
27 | 27 | | including any financial impact on the state resulting from a |
---|
28 | 28 | | liquidity event involving a company whose project was funded under |
---|
29 | 29 | | that subchapter. |
---|
30 | 30 | | SECTION 2. Section 490.056, Government Code, is amended by |
---|
31 | 31 | | amending Subsection (c) and adding Subsection (c-1) to read as |
---|
32 | 32 | | follows: |
---|
33 | 33 | | (c) Each entity recommended by the committee for an award of |
---|
34 | 34 | | money under Subchapter D [from the fund as provided by this chapter] |
---|
35 | 35 | | shall obtain and provide the following information to the office of |
---|
36 | 36 | | the governor: |
---|
37 | 37 | | (1) a federal criminal history background check for |
---|
38 | 38 | | each principal of the entity; |
---|
39 | 39 | | (2) a state criminal history background check for each |
---|
40 | 40 | | principal of the entity; |
---|
41 | 41 | | (3) a credit check for each principal of the entity; |
---|
42 | 42 | | (4) a copy of a government-issued form of photo |
---|
43 | 43 | | identification for each principal of the entity; and |
---|
44 | 44 | | (5) information regarding whether the entity or a |
---|
45 | 45 | | principal of the entity has ever been subject to a sanction imposed |
---|
46 | 46 | | by the Securities and Exchange Commission for a violation of |
---|
47 | 47 | | applicable federal law. |
---|
48 | 48 | | (c-1) A criminal history background check provided for a |
---|
49 | 49 | | principal of an entity under Subsection (c) remains in effect for |
---|
50 | 50 | | five years, regardless of the number of applications for funding |
---|
51 | 51 | | under this chapter submitted by the entity during that period. |
---|
52 | 52 | | SECTION 3. Section 490.057(a), Government Code, is amended |
---|
53 | 53 | | to read as follows: |
---|
54 | 54 | | (a) Except as provided by Subsection (b), information |
---|
55 | 55 | | collected by the governor's office, the committee, or the |
---|
56 | 56 | | committee's advisory panels concerning the identity, background, |
---|
57 | 57 | | finance, marketing plans, trade secrets, or other commercially or |
---|
58 | 58 | | academically sensitive information of an individual or entity |
---|
59 | 59 | | applying for, being considered for, receiving, or having received |
---|
60 | 60 | | an award from the fund is confidential unless the individual or |
---|
61 | 61 | | entity consents to disclosure of the information. |
---|
62 | 62 | | SECTION 4. This Act takes effect September 1, 2013. |
