9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter A, Chapter 33, Human Resources Code, | |
11 | 11 | is amended by adding Section 33.036 to read as follows: | |
12 | 12 | Sec. 33.036. PURCHASE OF ENERGY DRINKS PROHIBITED UNDER | |
13 | 13 | SUPPLEMENTAL NUTRITION ASSISTANCE PROGRAM. (a) In this section, | |
14 | 14 | "energy drink" means a beverage containing at least 65 milligrams | |
15 | 15 | of caffeine per 8 fluid ounces that is advertised as being | |
16 | 16 | specifically designed to provide metabolic stimulation or an | |
17 | 17 | increase to the consumer's mental or physical energy. The term does | |
18 | 18 | not include coffee or any substantially coffee-based beverage. | |
19 | 19 | (b) A recipient may not use supplemental nutrition | |
20 | 20 | assistance benefits to purchase an energy drink. | |
21 | 21 | (c) The department shall conduct a public outreach campaign | |
22 | 22 | to promote awareness of the prohibition under this section. | |
23 | 23 | SECTION 2. If before implementing any provision of this Act | |
24 | 24 | a state agency determines that authorization from a federal agency | |
25 | 25 | is necessary for implementation of that provision, the agency | |
26 | 26 | affected by the provision shall request the authorization and may | |
27 | 27 | delay implementing that provision until the authorization is | |
28 | 28 | granted. | |
29 | 29 | SECTION 3. This Act takes effect September 1, 2013. |
