99 AN ACT
1010 relating to the representation of certain applicants for writs of
1111 habeas corpus in cases involving the death penalty.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Article 26.044(n), Code of Criminal Procedure,
1414 is amended to read as follows:
1515 (n) An attorney employed by a public defender's office may
1616 be appointed with respect to an application for a writ of habeas
1717 corpus filed under Article 11.071 only if:
1818 (1) an attorney employed by the office of capital
1919 writs is not appointed in the case; and
2020 (2) the attorney employed by the public defender's
2121 office is on the list of competent counsel maintained under Section
2222 78.056, Government Code.
2323 SECTION 2. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2013.
