99 AN ACT
1010 relating to the requirements for issuance of certain barbering and
1111 cosmetology licenses and certificates for applicants holding
1212 licenses issued by other states; imposing fees.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. The heading to Section 1601.265, Occupations
1515 Code, is amended to read as follows:
1616 Sec. 1601.265. WAIVER OF CERTAIN LICENSE AND CERTIFICATE
1717 REQUIREMENTS; PERSONAL INTERVIEW.
1818 SECTION 2. Section 1601.265, Occupations Code, is amended
1919 by amending Subsection (a) and adding Subsections (a-1) and (c) to
2020 read as follows:
2121 (a) The department shall issue a license or certificate to
2222 an applicant for a license or certificate issued under Section
2323 1601.253, 1601.256, 1601.258, or 1601.259 if the applicant:
2424 (1) submits an application on a form prescribed by the
2525 department;
2626 (2) pays the application fee; and
2727 (3) provides proof that the applicant holds a current
2828 license to engage in the same or a similar activity issued by
2929 another jurisdiction that has license requirements substantially
3030 equivalent to those of this state.
3131 (a-1) The department may waive any [license] requirement
3232 for a license or certificate issued under this chapter, other than a
3333 license or certificate listed in Subsection (a), for an applicant
3434 holding a license from another state or country that has license
3535 requirements substantially equivalent to those of this state.
3636 (c) A license or certificate issued under Subsection (a)
3737 must be renewed as provided by Subchapter I.
3838 SECTION 3. Subchapter F, Chapter 1602, Occupations Code, is
3939 amended by adding Section 1602.268 to read as follows:
4040 Sec. 1602.268. WAIVER OF CERTAIN LICENSE REQUIREMENTS. (a)
4141 The department shall issue a license to an applicant for a license
4242 issued under Section 1602.254 if the applicant:
4343 (1) submits an application on a form prescribed by the
4444 department;
4545 (2) pays the application fee; and
4646 (3) provides proof that the applicant holds a current
4747 license to engage in the same or a similar activity issued by
4848 another state that has license requirements substantially
4949 equivalent to those of this state.
5050 (b) The department may waive any requirement for a license
5151 or certificate issued under this chapter, other than a license
5252 listed in Subsection (a), for an applicant holding a license from
5353 another state that has license requirements substantially
5454 equivalent to those of this state.
5555 (c) A license issued under Subsection (a) must be renewed as
5656 provided by Subchapter H.
5757 SECTION 4. The changes in law made by this Act apply only to
5858 an application for the issuance of a license or certificate under
5959 Chapters 1601 and 1602, Occupations Code, as amended by this Act,
6060 that is filed with the Texas Department of Licensing and Regulation
6161 on or after the effective date of this Act. An application for the
6262 issuance of a license or certificate that is filed before the
6363 effective date of this Act is governed by the law in effect on the
6464 date the application was filed, and the former law is continued in
6565 effect for that purpose.
6666 SECTION 5. This Act takes effect September 1, 2013.
