10	10	relating to the requirements for issuance of certain barbering and
11	11	cosmetology licenses and certificates for applicants holding
12	12	licenses issued by other states; imposing fees.
13	13	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	14	SECTION 1. The heading to Section 1601.265, Occupations
15	15	Code, is amended to read as follows:
16	16	Sec. 1601.265. WAIVER OF CERTAIN LICENSE AND CERTIFICATE
17	17	REQUIREMENTS; PERSONAL INTERVIEW.
18	18	SECTION 2. Section 1601.265, Occupations Code, is amended
19	19	by amending Subsection (a) and adding Subsections (a-1) and (c) to
20	20	read as follows:
21	21	(a) The department shall issue a license or certificate to
22	22	an applicant for a license or certificate issued under Section
23	23	1601.253, 1601.256, 1601.258, or 1601.259 if the applicant:
24	24	(1) submits an application on a form prescribed by the
25	25	department;
26	26	(2) pays the application fee; and
27	27	(3) provides proof that the applicant holds a current
28	28	license to engage in the same or a similar activity issued by
29	29	another jurisdiction that has license requirements substantially
30	30	equivalent to those of this state.
31	31	(a-1) The department may waive any [license] requirement
32	32	for a license or certificate issued under this chapter, other than a
33	33	license or certificate listed in Subsection (a), for an applicant
34	34	holding a license from another state or country that has license
35	35	requirements substantially equivalent to those of this state.
36	36	(c) A license or certificate issued under Subsection (a)
37	37	must be renewed as provided by Subchapter I.
38	38	SECTION 3. Subchapter F, Chapter 1602, Occupations Code, is
39	39	amended by adding Section 1602.268 to read as follows:
40	40	Sec. 1602.268. WAIVER OF CERTAIN LICENSE REQUIREMENTS. (a)
41	41	The department shall issue a license to an applicant for a license
42	42	issued under Section 1602.254 if the applicant:
43	43	(1) submits an application on a form prescribed by the
44	44	department;
45	45	(2) pays the application fee; and
46	46	(3) provides proof that the applicant holds a current
47	47	license to engage in the same or a similar activity issued by
48	48	another state that has license requirements substantially
49	49	equivalent to those of this state.
50	50	(b) The department may waive any requirement for a license
51	51	or certificate issued under this chapter, other than a license
52	52	listed in Subsection (a), for an applicant holding a license from
53	53	another state that has license requirements substantially
54	54	equivalent to those of this state.
55	55	(c) A license issued under Subsection (a) must be renewed as
56	56	provided by Subchapter H.
57	57	SECTION 4. The changes in law made by this Act apply only to
58	58	an application for the issuance of a license or certificate under
59	59	Chapters 1601 and 1602, Occupations Code, as amended by this Act,
60	60	that is filed with the Texas Department of Licensing and Regulation
61	61	on or after the effective date of this Act. An application for the
62	62	issuance of a license or certificate that is filed before the
63	63	effective date of this Act is governed by the law in effect on the
64	64	date the application was filed, and the former law is continued in
65	65	effect for that purpose.
66	66	SECTION 5. This Act takes effect September 1, 2013.
