99 AN ACT
1010 relating to the creation of an offense for use of a handheld
1111 wireless communication device for text-based communication while
1212 operating a motor vehicle.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. This Act may be cited as the Alex Brown Memorial
1515 Act.
1616 SECTION 2. Section 545.424, Transportation Code, is amended
1717 by adding Subsection (g) to read as follows:
1818 (g) An offense under Subsection (a) or (b) is a misdemeanor
1919 punishable by a fine of not more than $100 unless it is shown on the
2020 trial of the offense that the defendant has been previously
2121 convicted at least one time of an offense under this section, in
2222 which event the offense is punishable by a fine of not more than
2323 $200.
2424 SECTION 3. The heading to Section 545.425, Transportation
2525 Code, is amended to read as follows:
2626 Sec. 545.425. USE OF WIRELESS COMMUNICATION DEVICE
2727 GENERALLY; OFFENSE.
2828 SECTION 4. Section 545.425(a)(1), Transportation Code, is
2929 amended to read as follows:
3030 (1) "Hands-free device" means speakerphone
3131 capability, [or] a telephone attachment, or another function or
3232 other piece of equipment, regardless of whether permanently
3333 installed in or on a wireless communication device or in a [the]
3434 motor vehicle, that allows use of the wireless communication device
3535 without use of either of the operator's hands, except to activate or
3636 deactivate a function of the wireless communication device or
3737 hands-free device.
3838 SECTION 5. Subchapter I, Chapter 545, Transportation Code,
3939 is amended by adding Section 545.4251 to read as follows:
4040 Sec. 545.4251. USE OF WIRELESS COMMUNICATION DEVICE TO SEND
4141 TEXT-BASED COMMUNICATIONS; OFFENSE. (a) In this section:
4242 (1) "Handheld wireless communication device" means a
4343 wireless communication device, as defined by Section 545.425, that
4444 is portable.
4545 (2) "Text-based communication" means a communication
4646 that is designed or intended to be composed with at least one hand
4747 on a handheld wireless communication device and that is transmitted
4848 between wireless communication devices for the purpose of manually
4949 communicating in a nonspoken manner with another person in a
5050 written medium. The term includes:
5151 (A) a text message;
5252 (B) an instant message;
5353 (C) an e-mail; or
5454 (D) another type of electronic message.
5555 (b) An operator commits an offense if the operator uses a
5656 handheld wireless communication device to read, write, or send a
5757 text-based communication while operating a motor vehicle unless the
5858 vehicle is stopped.
5959 (c) It is a defense to prosecution under Subsection (b)
6060 that:
6161 (1) the operator used a handheld wireless
6262 communication device:
6363 (A) to read, select, or enter a telephone number
6464 or name for the purpose of making a telephone call;
6565 (B) in conjunction with voice-operated
6666 technology, a push-to-talk function, or a hands-free device, as
6767 defined by Section 545.425;
6868 (C) to navigate using a global positioning system
6969 or navigation service; or
7070 (D) to report illegal activity or summon
7171 emergency help; or
7272 (2) the handheld wireless communication device:
7373 (A) was used by the operator to relay information
7474 between the operator and a dispatcher in the course of the
7575 operator's occupational duties; and
7676 (B) was affixed to the vehicle.
7777 (d) Subsection (b) does not apply to:
7878 (1) an operator of an authorized emergency or law
7979 enforcement vehicle using a wireless communication device while
8080 acting in an official capacity; or
8181 (2) an operator who is licensed by the Federal
8282 Communications Commission while operating a radio frequency device
8383 other than a handheld wireless communication device.
8484 (e) This section preempts all local ordinances, rules, or
8585 regulations that are inconsistent with specific provisions of this
8686 section adopted by a political subdivision of this state relating
8787 to using a wireless communication device to read, write, or send a
8888 text-based communication while operating a motor vehicle.
8989 (f) An offense under this section is a misdemeanor
9090 punishable by a fine of not more than $100 unless it is shown on the
9191 trial of the offense that the defendant has been previously
9292 convicted at least one time of an offense under this section, in
9393 which event the offense is punishable by a fine of not more than
9494 $200.
9595 SECTION 6. This Act takes effect September 1, 2013.
