88 AN ACT
99 relating to reimbursing public institutions of higher education for
1010 tuition and fee exemptions for certain military personnel and their
1111 dependents.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 54.341, Education Code, is amended by
1414 adding Subsection (o) to read as follows:
1515 (o) The Texas Higher Education Coordinating Board shall
1616 reimburse an institution of higher education for all or a portion of
1717 the cost to the institution in providing exemptions under this
1818 section if any legislative appropriation is made to the
1919 coordinating board for that purpose. If the amount appropriated,
2020 if any, is insufficient to fully reimburse each institution under
2121 this subsection for a state fiscal year, the coordinating board
2222 shall provide the reimbursements based on the proportionate costs
2323 to the institutions in providing the exemptions. The coordinating
2424 board may use a reasonable portion of the money appropriated to the
2525 coordinating board for the purpose of this subsection, not to
2626 exceed one percent, for the costs of administering this subsection.
2727 The coordinating board by rule shall establish procedures for an
2828 institution to:
2929 (1) request reimbursement under this subsection; and
3030 (2) submit data requested by the coordinating board as
3131 necessary to administer this subsection.
3232 SECTION 2. The change in law made by this Act applies
3333 beginning with tuition and fee exemptions granted for the 2013 fall
3434 semester.
3535 SECTION 3. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each house, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect September 1, 2013.
