 A BILL TO BE ENTITLED
 AN ACT
 relating to reimbursing public institutions of higher education for
 tuition and fee exemptions for certain military personnel and their
 dependents.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 54.341, Education Code, is amended by
 adding Subsection (o) to read as follows:
 (o)  The Texas Higher Education Coordinating Board shall
 reimburse an institution of higher education for all or a portion of
 the cost to the institution in providing exemptions under this
 section if any legislative appropriation is made to the
 coordinating board for that purpose. If the amount appropriated,
 if any, is insufficient to fully reimburse each institution under
 this subsection for a state fiscal year, the coordinating board
 shall provide the reimbursements based on the proportionate costs
 to the institutions in providing the exemptions.  The coordinating
 board may use a reasonable portion of the money appropriated to the
 coordinating board for the purpose of this subsection, not to
 exceed one percent, for the costs of administering this subsection.
 The coordinating board by rule shall establish procedures for an
 institution to:
 (1)  request reimbursement under this subsection; and
 (2)  submit data requested by the coordinating board as
 necessary to administer this subsection.
 SECTION 2.  The change in law made by this Act applies
 beginning with tuition and fee exemptions granted for the 2013 fall
 semester.
 SECTION 3.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2013.
