88 A BILL TO BE ENTITLED
99 AN ACT
1010 relating to the Corn Hill Regional Water Authority; providing
1111 authority to impose fees and taxes.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 8364.004(c), Special District Local Laws
1414 Code, is amended to read as follows:
1515 (c) The authority is created to accomplish:
1616 (1) the control, storage, conservation, preservation,
1717 distribution, and use of water for domestic, industrial, municipal,
1818 and all other useful purposes as provided by Section 59, Article
1919 XVI, Texas Constitution;
2020 (2) the reclamation and drainage of the district's
2121 overflowed lands and other lands needing drainage;
2222 (3) the control, abatement, and change of any shortage
2323 or harmful excess of water; and
2424 (4) the protection, preservation, and restoration of
2525 the purity and sanitary condition of water within the state.
2626 SECTION 2. Subchapter B, Chapter 8364, Special District
2727 Local Laws Code, is amended by adding Section 8364.052 to read as
2828 follows:
2929 Sec. 8364.052. EX OFFICIO DIRECTORS. (a) At any time, the
3030 board may by resolution:
3131 (1) appoint a nonvoting ex officio director to serve
3232 at the pleasure of the board; and
3333 (2) remove an ex officio director.
3434 (b) An ex officio director:
3535 (1) is entitled to all notices and information given
3636 to and accessible to a director; and
3737 (2) may attend and participate in any board meeting.
3838 SECTION 3. Section 8364.072(a), Special District Local Laws
3939 Code, is amended to read as follows:
4040 (a) A municipality, county, or other political subdivision
4141 may petition the board to add that municipality, county, or other
4242 political subdivision as a member entity.
4343 SECTION 4. Section 8364.103, Special District Local Laws
4444 Code, is amended to read as follows:
4545 Sec. 8364.103. MUNICIPAL UTILITY DISTRICT POWERS AND
4646 DUTIES; LIMITATIONS. (a) Except as provided by Subsection
4747 [Subsections] (b) [and (c)], the authority has the powers and
4848 duties provided by the general law of this state, including
4949 Chapters 49 and 54, Water Code, applicable to municipal utility
5050 districts created under Section 59, Article XVI, Texas
5151 Constitution.
5252 (b) The authority may not provide [wastewater, drainage,]
5353 solid waste disposal[,] or road facilities or services.
5454 [(c) The authority does not have any power that the member
5555 entities do not have.]
5656 SECTION 5. Section 8364.151(a), Special District Local Laws
5757 Code, is amended to read as follows:
5858 (a) For any authorized authority purpose, the authority may
5959 issue bonds or other obligations payable wholly or partly from
6060 revenue of the authority's water system, sanitary sewer system, or
6161 drainage system, including revenue from contracts with member
6262 entities or customers, or any combination of those sources of
6363 revenue.
6464 SECTION 6. Subchapter D, Chapter 8364, Special District
6565 Local Laws Code, is amended by adding Section 8364.153 to read as
6666 follows:
6767 Sec. 8364.153. FUNDING BY MEMBERS. Under a contract with
6868 the authority, a member entity may make payments from any of the
6969 member entity's sources of revenue, including ad valorem taxes,
7070 impact fees, grants, sales and use taxes, and any other source to
7171 provide money for the administrative and operating expenses of the
7272 authority.
7373 SECTION 7. (a) The legal notice of the intention to
7474 introduce this Act, setting forth the general substance of this
7575 Act, has been published as provided by law, and the notice and a
7676 copy of this Act have been furnished to all persons, agencies,
7777 officials, or entities to which they are required to be furnished
7878 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
7979 Government Code.
8080 (b) The governor, one of the required recipients, has
8181 submitted the notice and Act to the Texas Commission on
8282 Environmental Quality.
8383 (c) The Texas Commission on Environmental Quality has filed
8484 its recommendations relating to this Act with the governor, the
8585 lieutenant governor, and the speaker of the house of
8686 representatives within the required time.
8787 (d) All requirements of the constitution and laws of this
8888 state and the rules and procedures of the legislature with respect
8989 to the notice, introduction, and passage of this Act are fulfilled
9090 and accomplished.
9191 SECTION 8. This Act takes effect immediately if it receives
9292 a vote of two-thirds of all the members elected to each house, as
9393 provided by Section 39, Article III, Texas Constitution. If this
9494 Act does not receive the vote necessary for immediate effect, this
9595 Act takes effect September 1, 2013.
