99 AN ACT
1010 relating to a waiver allowing the Department of Family and
1111 Protective Services to use certain federal funds to test innovation
1212 strategies in child welfare programs.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subchapter C, Chapter 40, Human Resources Code,
1515 is amended by adding Section 40.074 to read as follows:
1616 Sec. 40.074. WAIVER TO USE FUNDS TO TEST INNOVATIONS TO
1717 CHILD WELFARE PROGRAMS. (a) The department shall apply for and
1818 actively pursue a waiver, as authorized by the Child and Family
1919 Services Improvement and Innovation Act (Pub. L. No. 112-34), to
2020 allow the department to use federal funds available under Title
2121 IV-E, Social Security Act (42 U.S.C. Section 670 et seq.), to
2222 conduct demonstration projects to accomplish one or more of the
2323 following goals:
2424 (1) providing more permanency for children by reducing
2525 time in foster care and promoting successful transitions to
2626 adulthood for former foster youth;
2727 (2) increasing positive outcomes for infants,
2828 children, and families in their homes and communities and
2929 increasing the safety and well-being of infants, children, and
3030 youth; and
3131 (3) preventing child abuse and neglect and the reentry
3232 of children into foster care.
3333 (b) This section expires December 31, 2015.
3434 SECTION 2. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2013.
