| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter A, Chapter 62, Parks and Wildlife |
|---|
| 13 | 13 | | Code, is amended by adding Section 62.0122 to read as follows: |
|---|
| 14 | 14 | | Sec. 62.0122. HUNTER AWARENESS OF NEARBY SCHOOL. (a) In |
|---|
| 15 | 15 | | this section, "school" means a private or public elementary or |
|---|
| 16 | 16 | | secondary school. |
|---|
| 17 | 17 | | (b) At the request of a school district, the Texas |
|---|
| 18 | 18 | | Department of Transportation shall: |
|---|
| 19 | 19 | | (1) place signs in appropriate places along state or |
|---|
| 20 | 20 | | federal highways to alert hunters to the proximity of a school; and |
|---|
| 21 | 21 | | (2) act jointly with municipalities and counties, as |
|---|
| 22 | 22 | | appropriate, to place signs along roadways maintained and operated |
|---|
| 23 | 23 | | by a municipality or county to alert hunters to the proximity of a |
|---|
| 24 | 24 | | school. |
|---|
| 25 | 25 | | (c) A school district that requests a sign under Subsection |
|---|
| 26 | 26 | | (b) must pay the costs of the production and placement of the sign. |
|---|
| 27 | 27 | | SECTION 2. Section 62.014, Parks and Wildlife Code, is |
|---|
| 28 | 28 | | amended by amending Subsection (b) and adding Subsection (b-1) to |
|---|
| 29 | 29 | | read as follows: |
|---|
| 30 | 30 | | (b) The department may establish and administer a statewide |
|---|
| 31 | 31 | | hunter education program. The program must include but is not |
|---|
| 32 | 32 | | limited to instruction concerning: |
|---|
| 33 | 33 | | (1) the safe handling and use of firearms, archery |
|---|
| 34 | 34 | | equipment, and crossbows; |
|---|
| 35 | 35 | | (2) wildlife conservation and management; |
|---|
| 36 | 36 | | (3) hunting laws and applicable rules and regulations; |
|---|
| 37 | 37 | | and |
|---|
| 38 | 38 | | (4) hunting safety and ethics, including landowners' |
|---|
| 39 | 39 | | rights and a hunter's personal responsibility as it applies to the |
|---|
| 40 | 40 | | discharge of a firearm. |
|---|
| 41 | 41 | | (b-1) The department shall include, in a hunter education |
|---|
| 42 | 42 | | program established under this section, in any written or |
|---|
| 43 | 43 | | Internet-based information produced by the department for the |
|---|
| 44 | 44 | | public that relates to hunting, and in any curricular materials |
|---|
| 45 | 45 | | that relate to hunting, information on: |
|---|
| 46 | 46 | | (1) awareness of school property and other |
|---|
| 47 | 47 | | surroundings and the danger of discharging a firearm across the |
|---|
| 48 | 48 | | property line of a school; and |
|---|
| 49 | 49 | | (2) personal responsibility as it applies to the |
|---|
| 50 | 50 | | discharge of a firearm. |
|---|
| 51 | 51 | | SECTION 3. This Act takes effect September 1, 2013. |
