99 relating to certain voting procedures for certain property owners'
1010 associations.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 209.0058, Property Code, as added by
1313 Chapter 1026 (H.B. 2761), Acts of the 82nd Legislature, Regular
1414 Session, 2011, is amended by amending Subsections (a) and (b) and
1515 adding Subsection (d) to read as follows:
1616 (a) Except as provided by Subsection (d), any [Any] vote
1717 cast in an election or vote by a member of a property owners'
1818 association must be in writing and signed by the member.
1919 (b) Electronic votes cast under Section 209.00592 shall be
2020 considered [constitute] written and signed ballots if the identity
2121 of the property owner submitting the ballot can be confirmed.
2222 (d) The property owners' association board may elect to
2323 allow each vote cast in an election or each vote cast by a member of
2424 the property owners' association to be by secret ballot.
2525 SECTION 2. (a) This section takes effect only if the Act of
2626 the 83rd Legislature, Regular Session, 2013, relating to
2727 nonsubstantive additions to and corrections in enacted codes does
2828 not become law.
2929 (b) Section 209.0058, Property Code, as added by Chapter
3030 1217 (S.B. 472), Acts of the 82nd Legislature, Regular Session,
3131 2011, is amended by amending Subsections (a) and (b) and adding
3232 Subsection (d) to read as follows:
3333 (a) Except as provided by Subsection (d), any [Any] vote
3434 cast in an election or vote by a member of a property owners'
3535 association must be in writing and signed by the member.
3636 (b) Electronic votes cast under Section 209.00593 shall be
3737 considered [constitute] written and signed ballots if the identity
3838 of the property owner submitting the ballot can be confirmed.
3939 (d) The property owners' association board may elect to
4040 allow each vote cast in an election or each vote cast by a member of
4141 the property owners' association to be by secret ballot.
4242 SECTION 3. Section 209.00592, Property Code, as added by
4343 Chapter 1026 (H.B. 2761), Acts of the 82nd Legislature, Regular
4444 Session, 2011, is amended by amending Subsections (a) and (d) and
4545 adding Subsection (b-1) to read as follows:
4646 (a) Subject to Subsection (b-1), the [The] voting rights of
4747 an owner may be cast or given:
4848 (1) in person or by proxy at a meeting of the property
4949 owners' association;
5050 (2) by absentee ballot in accordance with this
5151 section;
5252 (3) by electronic ballot in accordance with this
5353 section; or
5454 (4) by any method of representative or delegated
5555 voting provided by a dedicatory instrument.
5656 (b-1) If a property owners' association board elects to
5757 allow voting by secret ballot under Section 209.0058(d), the
5858 property owners' association must provide a practical and effective
5959 means for each vote cast in an election or each vote cast by a member
6060 of the property owners' association to be by secret ballot.
6161 (d) For the purposes of this section, "electronic ballot"
6262 means a ballot:
6363 (1) given by:
6464 (A) e-mail;
6565 (B) facsimile; or
6666 (C) posting on an Internet website;
6767 (2) for which the identity of the property owner
6868 submitting the ballot can be confirmed, unless the board elects to
6969 allow voting by secret ballot under Section 209.0058(d); and
7070 (3) for which the property owner may receive a receipt
7171 of the electronic transmission and receipt of the owner's ballot.
7272 SECTION 4. (a) This section takes effect only if the Act of
7373 the 83rd Legislature, Regular Session, 2013, relating to
7474 nonsubstantive additions to and corrections in enacted codes does
7575 not become law.
7676 (b) Section 209.00593, Property Code, as added by Chapter
7777 1217 (S.B. 472), Acts of the 82nd Legislature, Regular Session,
7878 2011, is amended by amending Subsections (a) and (d) and adding
7979 Subsection (b-1) to read as follows:
8080 (a) Subject to Subsection (b-1), the [The] voting rights of
8181 an owner may be cast or given:
8282 (1) in person or by proxy at a meeting of the property
8383 owners' association;
8484 (2) by absentee ballot in accordance with this
8585 section;
8686 (3) by electronic ballot in accordance with this
8787 section; or
8888 (4) by any method of representative or delegated
8989 voting provided by a dedicatory instrument.
9090 (b-1) If a property owners' association board elects to
9191 allow voting by secret ballot under Section 209.0058(d), the
9292 property owners' association must provide a practical and effective
9393 means for each vote cast in an election or each vote cast by a member
9494 of the property owners' association to be by secret ballot.
9595 (d) For the purposes of this section, "electronic ballot"
9696 means a ballot:
9797 (1) given by:
9898 (A) e-mail;
9999 (B) facsimile; or
100100 (C) posting on an Internet website;
101101 (2) for which the identity of the property owner
102102 submitting the ballot can be confirmed, unless the board elects to
103103 allow voting by secret ballot under Section 209.0058(d); and
104104 (3) for which the property owner may receive a receipt
105105 of the electronic transmission and receipt of the owner's ballot.
106106 SECTION 5. To the extent of any conflict, this Act prevails
107107 over another Act of the 83rd Legislature, Regular Session, 2013,
108108 relating to nonsubstantive additions to and corrections in enacted
109109 codes.
110110 SECTION 6. This Act takes effect January 1, 2014.
