77 relating to an exception to the domicile requirement for issuance
88 of a commercial driver's license for certain military personnel.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 522.022, Transportation Code, is amended
1111 to read as follows:
1212 Sec. 522.022. LICENSE REQUIREMENTS. The department may not
1313 issue a commercial driver's license other than a nonresident
1414 license to a person unless the person:
1515 (1) has a domicile:
1616 (A) in this state; or
1717 (B) in another state and is a member of the United
1818 States armed forces, including a member of the National Guard or a
1919 reserve or auxiliary unit of any branch of the armed forces, whose
2020 temporary or permanent duty station is located in this state;
2121 (2) has passed knowledge and skills tests for driving
2222 a commercial motor vehicle that comply with minimal federal
2323 standards established by 49 C.F.R. Part 383, Subparts G and H; and
2424 (3) has satisfied the requirements imposed by the
2525 federal act, federal regulation, or state law.
2626 SECTION 2. This Act takes effect September 1, 2013.
