99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 1958.152, Occupations
1111 Code, is amended to read as follows:
1212 Sec. 1958.152. REMEDIATION WORK PLAN AND AGREEMENT;
1313 CONSUMER INFORMATION.
1414 SECTION 2. Section 1958.152, Occupations Code, is amended
1515 by amending Subsection (a) and adding Subsections (a-1) and (c) to
1616 read as follows:
1717 (a) A license holder who intends to perform mold remediation
1818 shall prepare a work plan providing instructions for the
1919 remediation efforts to be performed for the mold remediation
2020 project.
2121 (a-1) Before the mold remediation begins, the [The] license
2222 holder must:
2323 (1) [shall] provide the work plan and a mold
2424 information sheet to the client; and
2525 (2) obtain a signed agreement with the property owner
2626 concerning the terms and scope of the mold remediation project
2727 [before the mold remediation begins].
2828 (c) The department shall prescribe the form and content of
2929 the mold information sheet described by Subsection (a-1)(1).
3030 SECTION 3. The change in law made by this Act to Section
3131 1958.152, Occupations Code, applies only to a mold remediation
3232 project commenced on or after the effective date of this Act. A mold
3333 remediation project commenced before the effective date of this Act
3434 is governed by the law in effect when the project commenced, and the
3535 former law is continued in effect for that purpose.
3636 SECTION 4. The executive commissioner of the Health and
3737 Human Services Commission shall adopt rules to implement Section
3838 1958.152(c), Occupations Code, as added by this Act, not later than
3939 December 1, 2013.
4040 SECTION 5. This Act takes effect September 1, 2013.
