| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Section 1958.152, Occupations |
|---|
| 11 | 11 | | Code, is amended to read as follows: |
|---|
| 12 | 12 | | Sec. 1958.152. REMEDIATION WORK PLAN AND AGREEMENT; |
|---|
| 13 | 13 | | CONSUMER INFORMATION. |
|---|
| 14 | 14 | | SECTION 2. Section 1958.152, Occupations Code, is amended |
|---|
| 15 | 15 | | by amending Subsection (a) and adding Subsections (a-1) and (c) to |
|---|
| 16 | 16 | | read as follows: |
|---|
| 17 | 17 | | (a) A license holder who intends to perform mold remediation |
|---|
| 18 | 18 | | shall prepare a work plan providing instructions for the |
|---|
| 19 | 19 | | remediation efforts to be performed for the mold remediation |
|---|
| 20 | 20 | | project. |
|---|
| 21 | 21 | | (a-1) Before the mold remediation begins, the [The] license |
|---|
| 22 | 22 | | holder must: |
|---|
| 23 | 23 | | (1) [shall] provide the work plan and a mold |
|---|
| 24 | 24 | | information sheet to the client; and |
|---|
| 25 | 25 | | (2) obtain a signed agreement with the property owner |
|---|
| 26 | 26 | | concerning the terms and scope of the mold remediation project |
|---|
| 27 | 27 | | [before the mold remediation begins]. |
|---|
| 28 | 28 | | (c) The department shall prescribe the form and content of |
|---|
| 29 | 29 | | the mold information sheet described by Subsection (a-1)(1). |
|---|
| 30 | 30 | | SECTION 3. The change in law made by this Act to Section |
|---|
| 31 | 31 | | 1958.152, Occupations Code, applies only to a mold remediation |
|---|
| 32 | 32 | | project commenced on or after the effective date of this Act. A mold |
|---|
| 33 | 33 | | remediation project commenced before the effective date of this Act |
|---|
| 34 | 34 | | is governed by the law in effect when the project commenced, and the |
|---|
| 35 | 35 | | former law is continued in effect for that purpose. |
|---|
| 36 | 36 | | SECTION 4. The executive commissioner of the Health and |
|---|
| 37 | 37 | | Human Services Commission shall adopt rules to implement Section |
|---|
| 38 | 38 | | 1958.152(c), Occupations Code, as added by this Act, not later than |
|---|
| 39 | 39 | | December 1, 2013. |
|---|
| 40 | 40 | | SECTION 5. This Act takes effect September 1, 2013. |
