 A BILL TO BE ENTITLED
 AN ACT
 relating to certain requirements before completing mold
 remediation work.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  The heading to Section 1958.152, Occupations
 Code, is amended to read as follows:
 Sec. 1958.152.  REMEDIATION WORK PLAN AND AGREEMENT;
 CONSUMER INFORMATION.
 SECTION 2.  Section 1958.152, Occupations Code, is amended
 by amending Subsection (a) and adding Subsections (a-1) and (c) to
 read as follows:
 (a)  A license holder who intends to perform mold remediation
 shall prepare a work plan providing instructions for the
 remediation efforts to be performed for the mold remediation
 project.
 (a-1)  Before the mold remediation begins, the [The] license
 holder must:
 (1)  [shall] provide the work plan and a mold
 information sheet to the client; and
 (2)  obtain a signed agreement with the property owner
 concerning the terms and scope of the mold remediation project
 [before the mold remediation begins].
 (c)  The department shall prescribe the form and content of
 the mold information sheet described by Subsection (a-1)(1).
 SECTION 3.  The change in law made by this Act to Section
 1958.152, Occupations Code, applies only to a mold remediation
 project commenced on or after the effective date of this Act. A mold
 remediation project commenced before the effective date of this Act
 is governed by the law in effect when the project commenced, and the
 former law is continued in effect for that purpose.
 SECTION 4.  The executive commissioner of the Health and
 Human Services Commission shall adopt rules to implement Section
 1958.152(c), Occupations Code, as added by this Act, not later than
 December 1, 2013.
 SECTION 5.  This Act takes effect September 1, 2013.
