| 7 | 7 | | relating to reimbursement rates for certain therapy services |

| 8 | 8 | | provided to Medicaid recipients. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 32.028, Human Resources Code, is amended |
|---|
| 11 | 11 | | by adding Subsection (o) to read as follows: |
|---|
| 12 | 12 | | (o) The executive commissioner of the Health and Human |
|---|
| 13 | 13 | | Services Commission, in adopting reasonable rules and standards |
|---|
| 14 | 14 | | governing the determination of rates paid for physical, |
|---|
| 15 | 15 | | occupational, or speech therapy services under the medical |
|---|
| 16 | 16 | | assistance program, shall ensure that providers holding the same |
|---|
| 17 | 17 | | professional license and located in the same geographical region |
|---|
| 18 | 18 | | are reimbursed for the provision of a particular service at an equal |
|---|
| 19 | 19 | | rate, regardless of: |
|---|
| 20 | 20 | | (1) the setting in which the service is provided; or |
|---|
| 21 | 21 | | (2) whether the provider practices as a sole |
|---|
| 22 | 22 | | practitioner or is associated with or employed by another provider. |
|---|
| 23 | 23 | | SECTION 2. If before implementing any provision of this Act |
|---|
| 24 | 24 | | a state agency determines that a waiver or authorization from a |
|---|
| 25 | 25 | | federal agency is necessary for implementation of that provision, |
|---|
| 26 | 26 | | the agency affected by the provision shall request the waiver or |
|---|
| 27 | 27 | | authorization and may delay implementing that provision until the |
|---|
| 28 | 28 | | waiver or authorization is granted. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect September 1, 2013. |
