77 relating to reimbursement rates for certain therapy services
88 provided to Medicaid recipients.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 32.028, Human Resources Code, is amended
1111 by adding Subsection (o) to read as follows:
1212 (o) The executive commissioner of the Health and Human
1313 Services Commission, in adopting reasonable rules and standards
1414 governing the determination of rates paid for physical,
1515 occupational, or speech therapy services under the medical
1616 assistance program, shall ensure that providers holding the same
1717 professional license and located in the same geographical region
1818 are reimbursed for the provision of a particular service at an equal
1919 rate, regardless of:
2020 (1) the setting in which the service is provided; or
2121 (2) whether the provider practices as a sole
2222 practitioner or is associated with or employed by another provider.
2323 SECTION 2. If before implementing any provision of this Act
2424 a state agency determines that a waiver or authorization from a
2525 federal agency is necessary for implementation of that provision,
2626 the agency affected by the provision shall request the waiver or
2727 authorization and may delay implementing that provision until the
2828 waiver or authorization is granted.
2929 SECTION 3. This Act takes effect September 1, 2013.
