88 A JOINT RESOLUTION
99 proposing a constitutional amendment prohibiting the taxation of
1010 the sale or use of certain food and medicine.
1111 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Article VIII, Texas Constitution, is amended by
1313 adding Section 28 to read as follows:
1414 Sec. 28. (a) The legislature may not enact a general law
1515 that would impose a state tax on the sale or use of:
1616 (1) a food product for human consumption that was not
1717 subject to taxation under Chapter 151, Tax Code, on January 1, 2013;
1818 or
1919 (2) a medicine that was not subject to taxation under
2020 Chapter 151, Tax Code, on January 1, 2013.
2121 (b) This section may not be construed in a manner that would
2222 result in prohibiting the state from entering into an interstate
2323 agreement to simplify the administration and collection of the
2424 state's sales and use tax.
2525 SECTION 2. The following temporary provision is added to
2626 the Texas Constitution:
2727 TEMPORARY PROVISION. (a) This temporary provision applies
2828 to the constitutional amendment proposed by the 83rd Legislature,
2929 Regular Session, 2013, prohibiting the taxation of the sale or use
3030 of certain food and medicine and expires December 31, 2015.
3131 (b) If the 83rd Legislature, during the regular or a special
3232 session, enacts a general law prohibited by Section 28, Article
3333 VIII, of this constitution, the portion of the general law that
3434 violates that section expires January 1, 2015.
3535 SECTION 3. This proposed constitutional amendment shall be
3636 submitted to the voters at an election to be held November 5, 2013.
3737 The ballot shall be printed to permit voting for or against the
3838 proposition: "The constitutional amendment prohibiting the
3939 imposition of a tax on the sale or use of certain food and
4040 medicine."
