11 | 11 | | certain interventions and sanctions for the 2012-2013 school year. |

12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Section 39.116, Education Code, is amended by |
---|
14 | 14 | | amending Subsections (a), (b), (e), (f), and (g) and adding |
---|
15 | 15 | | Subsection (e-1) to read as follows: |
---|
16 | 16 | | (a) During the period of transition to the accreditation |
---|
17 | 17 | | system established under H.B. No. 3, Acts of the 81st Legislature, |
---|
18 | 18 | | Regular Session, 2009, to be implemented in August 2013, the |
---|
19 | 19 | | commissioner shall [may] suspend assignment of accreditation |
---|
20 | 20 | | statuses and performance ratings for the 2011-2012 and 2012-2013 |
---|
21 | 21 | | school years [year]. |
---|
22 | 22 | | (b) As soon as practicable following the 2012-2013 |
---|
23 | 23 | | [2011-2012] school year, the commissioner shall report district and |
---|
24 | 24 | | campus performance under the student achievement indicators under |
---|
25 | 25 | | Sections 39.053(c)(1)(A) and (B). |
---|
26 | 26 | | (e) During the 2011-2012, [and] 2012-2013, and 2013-2014 |
---|
27 | 27 | | school years, the commissioner shall continue to implement |
---|
28 | 28 | | interventions and sanctions for districts and campuses identified |
---|
29 | 29 | | as having unacceptable performance in the 2010-2011 school year in |
---|
30 | 30 | | accordance with the performance standards applicable during the |
---|
31 | 31 | | 2010-2011 school year and may increase or decrease the level of |
---|
32 | 32 | | interventions and sanctions based on an evaluation of the |
---|
33 | 33 | | district's or campus's performance. |
---|
34 | 34 | | (e-1) Subsection (e) does not apply to districts or campuses |
---|
35 | 35 | | that would have improved performance ratings had the performance |
---|
36 | 36 | | standards applicable during the 2012-2013 school year been in |
---|
37 | 37 | | effect in the 2010-2011 school year. |
---|
38 | 38 | | (f) For purposes of determining multiple years of |
---|
39 | 39 | | unacceptable performance and required district and campus |
---|
40 | 40 | | interventions and sanctions under this subchapter, the performance |
---|
41 | 41 | | ratings and accreditation statuses issued in the 2010-2011 and |
---|
42 | 42 | | 2013-2014 [2012-2013] school years shall be considered |
---|
43 | 43 | | consecutive. |
---|
44 | 44 | | (g) This section expires September 1, 2015 [2014]. |
---|
45 | 45 | | SECTION 2. Subsection (c), Section 39.116, Education Code, |
---|
46 | 46 | | is repealed. |
---|
47 | 47 | | SECTION 3. This Act takes effect immediately if it receives |
---|
48 | 48 | | a vote of two-thirds of all the members elected to each house, as |
---|
49 | 49 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
50 | 50 | | Act does not receive the vote necessary for immediate effect, this |
---|
51 | 51 | | Act takes effect September 1, 2013. |
