88 A BILL TO BE ENTITLED
99 AN ACT
1010 relating to suspending public school accountability ratings and
1111 certain interventions and sanctions for the 2012-2013 school year.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 39.116, Education Code, is amended by
1414 amending Subsections (a), (b), (e), (f), and (g) and adding
1515 Subsection (e-1) to read as follows:
1616 (a) During the period of transition to the accreditation
1717 system established under H.B. No. 3, Acts of the 81st Legislature,
1818 Regular Session, 2009, to be implemented in August 2013, the
1919 commissioner shall [may] suspend assignment of accreditation
2020 statuses and performance ratings for the 2011-2012 and 2012-2013
2121 school years [year].
2222 (b) As soon as practicable following the 2012-2013
2323 [2011-2012] school year, the commissioner shall report district and
2424 campus performance under the student achievement indicators under
2525 Sections 39.053(c)(1)(A) and (B).
2626 (e) During the 2011-2012, [and] 2012-2013, and 2013-2014
2727 school years, the commissioner shall continue to implement
2828 interventions and sanctions for districts and campuses identified
2929 as having unacceptable performance in the 2010-2011 school year in
3030 accordance with the performance standards applicable during the
3131 2010-2011 school year and may increase or decrease the level of
3232 interventions and sanctions based on an evaluation of the
3333 district's or campus's performance.
3434 (e-1) Subsection (e) does not apply to districts or campuses
3535 that would have improved performance ratings had the performance
3636 standards applicable during the 2012-2013 school year been in
3737 effect in the 2010-2011 school year.
3838 (f) For purposes of determining multiple years of
3939 unacceptable performance and required district and campus
4040 interventions and sanctions under this subchapter, the performance
4141 ratings and accreditation statuses issued in the 2010-2011 and
4242 2013-2014 [2012-2013] school years shall be considered
4343 consecutive.
4444 (g) This section expires September 1, 2015 [2014].
4545 SECTION 2. Subsection (c), Section 39.116, Education Code,
4646 is repealed.
4747 SECTION 3. This Act takes effect immediately if it receives
4848 a vote of two-thirds of all the members elected to each house, as
4949 provided by Section 39, Article III, Texas Constitution. If this
5050 Act does not receive the vote necessary for immediate effect, this
5151 Act takes effect September 1, 2013.
