14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

15 | 15 | | SECTION 1. Subchapter D, Chapter 39, Utilities Code, is |
---|
16 | 16 | | amended by adding Section 39.161 to read as follows: |
---|
17 | 17 | | Sec. 39.161. POWER REGION RESERVE MARGIN. (a) Not later |
---|
18 | 18 | | than July 1 of each year, the independent organization certified |
---|
19 | 19 | | under Section 39.151 for each power region shall study and project |
---|
20 | 20 | | for the following year the: |
---|
21 | 21 | | (1) anticipated and installed generation capacity |
---|
22 | 22 | | located in or capable of delivering electricity to the power |
---|
23 | 23 | | region; |
---|
24 | 24 | | (2) expected peak demand in the power region; and |
---|
25 | 25 | | (3) amount of reserve capacity necessary to maintain a |
---|
26 | 26 | | reliability standard set by the commission for the power region. |
---|
27 | 27 | | (b) If the independent organization determines under |
---|
28 | 28 | | Subsection (a) that the amount of reserve capacity available for |
---|
29 | 29 | | the following year will not maintain the reliability standard |
---|
30 | 30 | | relative to the expected peak demand and a capacity deficit may |
---|
31 | 31 | | occur, the organization shall acquire incremental capacity through |
---|
32 | 32 | | opt-in load participation programs, with at least 20 percent of the |
---|
33 | 33 | | incremental capacity being attained from each of the following |
---|
34 | 34 | | classes: |
---|
35 | 35 | | (1) residential; |
---|
36 | 36 | | (2) commercial; and |
---|
37 | 37 | | (3) industrial. |
---|
38 | 38 | | SECTION 2. This Act takes effect September 1, 2013. |
