1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to attaining reserve capacity margins in power regions to
1313 meet expected peak demand.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Subchapter D, Chapter 39, Utilities Code, is
1616 amended by adding Section 39.161 to read as follows:
1717 Sec. 39.161. POWER REGION RESERVE MARGIN. (a) Not later
1818 than July 1 of each year, the independent organization certified
1919 under Section 39.151 for each power region shall study and project
2020 for the following year the:
2121 (1) anticipated and installed generation capacity
2222 located in or capable of delivering electricity to the power
2323 region;
2424 (2) expected peak demand in the power region; and
2525 (3) amount of reserve capacity necessary to maintain a
2626 reliability standard set by the commission for the power region.
2727 (b) If the independent organization determines under
2828 Subsection (a) that the amount of reserve capacity available for
2929 the following year will not maintain the reliability standard
3030 relative to the expected peak demand and a capacity deficit may
3131 occur, the organization shall acquire incremental capacity through
3232 opt-in load participation programs, with at least 20 percent of the
3333 incremental capacity being attained from each of the following
3434 classes:
3535 (1) residential;
3636 (2) commercial; and
3737 (3) industrial.
3838 SECTION 2. This Act takes effect September 1, 2013.
