12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Article 62.0045, Code of Criminal Procedure, is |
---|
14 | 14 | | amended to read as follows: |
---|
15 | 15 | | Art. 62.0045. CENTRALIZED REGISTRATION AUTHORITY. |
---|
16 | 16 | | (a) The commissioners court of [in] a county [with a population of |
---|
17 | 17 | | 100,000 or more] may designate the office of the sheriff of the |
---|
18 | 18 | | county or may, through interlocal agreement, designate the office |
---|
19 | 19 | | of a chief of police of a municipality in that county to serve as a |
---|
20 | 20 | | mandatory countywide registration location for persons subject to |
---|
21 | 21 | | this chapter. |
---|
22 | 22 | | (b) Notwithstanding any other provision of this chapter, a |
---|
23 | 23 | | person [who is] subject to this chapter is required to perform the |
---|
24 | 24 | | registration and verification requirements of Articles [shall |
---|
25 | 25 | | register under Article] 62.051 and [or verify registration under |
---|
26 | 26 | | Article] 62.058 and the change of address requirements of Article |
---|
27 | 27 | | 62.055 only with respect to the centralized registration authority |
---|
28 | 28 | | for the county, regardless of whether the person resides in any |
---|
29 | 29 | | municipality located in that county. If the person resides in a |
---|
30 | 30 | | municipality, and the local law enforcement authority in the |
---|
31 | 31 | | municipality does not serve as the person's centralized |
---|
32 | 32 | | registration authority, the centralized registration authority, |
---|
33 | 33 | | not later than the third day after the date the person registers or |
---|
34 | 34 | | verifies registration or changes address with that authority, shall |
---|
35 | 35 | | provide to the local law enforcement authority in that municipality |
---|
36 | 36 | | notice of the person's registration, [or] verification of |
---|
37 | 37 | | registration, or change of address, as applicable, with the |
---|
38 | 38 | | centralized registration authority. |
---|
39 | 39 | | (c) This section does not affect a person's duty to register |
---|
40 | 40 | | with secondary sex offender registries under this chapter, such as |
---|
41 | 41 | | those described by Articles 62.059 and 62.153. |
---|
42 | 42 | | SECTION 2. This Act takes effect immediately if it receives |
---|
43 | 43 | | a vote of two-thirds of all the members elected to each house, as |
---|
44 | 44 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
45 | 45 | | Act does not receive the vote necessary for immediate effect, this |
---|
46 | 46 | | Act takes effect September 1, 2013. |
