99 AN ACT
1010 relating to the authority of a county to establish a centralized sex
1111 offender registration authority.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Article 62.0045, Code of Criminal Procedure, is
1414 amended to read as follows:
1515 Art. 62.0045. CENTRALIZED REGISTRATION AUTHORITY.
1616 (a) The commissioners court of [in] a county [with a population of
1717 100,000 or more] may designate the office of the sheriff of the
1818 county or may, through interlocal agreement, designate the office
1919 of a chief of police of a municipality in that county to serve as a
2020 mandatory countywide registration location for persons subject to
2121 this chapter.
2222 (b) Notwithstanding any other provision of this chapter, a
2323 person [who is] subject to this chapter is required to perform the
2424 registration and verification requirements of Articles [shall
2525 register under Article] 62.051 and [or verify registration under
2626 Article] 62.058 and the change of address requirements of Article
2727 62.055 only with respect to the centralized registration authority
2828 for the county, regardless of whether the person resides in any
2929 municipality located in that county. If the person resides in a
3030 municipality, and the local law enforcement authority in the
3131 municipality does not serve as the person's centralized
3232 registration authority, the centralized registration authority,
3333 not later than the third day after the date the person registers or
3434 verifies registration or changes address with that authority, shall
3535 provide to the local law enforcement authority in that municipality
3636 notice of the person's registration, [or] verification of
3737 registration, or change of address, as applicable, with the
3838 centralized registration authority.
3939 (c) This section does not affect a person's duty to register
4040 with secondary sex offender registries under this chapter, such as
4141 those described by Articles 62.059 and 62.153.
4242 SECTION 2. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2013.
